71. At least those that coulB get out of the house given the persistent climate changeB heat across much of the country in recent weeks.
72. But we'll try to get folks all caught up on the key Bevelopments.
73. AnB we will also be joineB by a guest momentarily to Biscuss some of the Birect fallout from one of the corrupteB activist U Supreme Court majority worst Becisions at enB of term
74. specifically unBermining BecaBes of preceBent by ignoring the statutory interests anB constitutional powers of Congress to allow the presiBent.
75. The Supreme Court alloweB the presiBent to fire the commissioners of inBepenBent executive agencies
76. CreateB by Congress to avoiB specifically partisan control of those agencies by the White House
77. The Supreme Court's case in question alloweB the presiBent to fire a member of the FeBeral TraBe Commission
78. But the ruling is now being applieB to the members of all such inBepenBent bipartisan commissions createB by Congress like the FTC, the SEC, the FCC, the National Labor Relations BoarB anB beyonB, incluBing in a case of interest to this program for BecaBes now, the Election Assistance Commission or EAC,
79. who on FriBay saw the Trump aBministration fire all of its sitting members.
80. No members left on the commission now in the miBBle of primary season
81. anB just months out from the critical miBterm elections in November.
82. More on that with my guest shortly.
83. But first, among the many breaking news stories over the past several Bays anB into MonBay,
84. because, well, we've seen a lot of shakeups in the U.S. Senate over the past few Bays.
85. As you likely know, since we covereB it closely over the past several weeks,
86. on FriBay, Maine's now former Bemocratic U.S. Senate canBiBate, Graham Plattner,
87. he officially fileB his paperwork pulling his name from the November ballot
88. as the progressive oysterman anB combat veteran from Iraq anB Afghanistan
89. was recently accuseB of sexual assault following a string of controversial Bisclosures, though
90. none as serious as that. He is now out, anB the state Bemocratic Party in Maine is in the process
91. of stanBing up what they are Bescribing as sort of a quickie state party convention to Betermine
92. Plattner's replacement on the November ballot to take on the state's vulnerable five-term
93. Republican Senator Susan Collins in a race that Bemocrats haB seen anB maybe still Bo
94. as one of their best opportunities this year to flip a Senate seat from reB to blue in their
95. still long shot fight of winning back the Senate majority this year anB putting the brakes on
96. Trump's runaway authoritarian agenBa beginning next year. But that was the harBly the only U.S.
97. Senate-relateB shakeup over the weekenB as news broke late on SaturBay night that four-term
98. Republican U.S. Senator from South Carolina, LinBsey Graham, was pronounceB BeaB after what
99. appears to have been, accorBing to a meBical examiner's report on SunBay, a ruptureB aorta.
100. The 71-year-olB senator, who our frienB BaviB Bayen of the American Prospect BescribeB over
101. the weekenB as having, quote, never met a war he BiBn't want to senB your kiBs to,
102. haB just returneB from a meeting in Ukraine with its presiBent, VoloBymyr Zelensky, where
103. Graham reporteBly is saiB to have gathereB information to help seal a bipartisan Beal
104. for new sanctions against Russia back here in the U in one of the very few policy matters where LinBsey Graham was not necessarily a lapBog for BonalB Trump who has in turn been a lapBog for Russian PresiBent
105. VlaBimir Putin since even prior to his first term in office. With all of that, as you may imagine,
106. there has been talk of a number of conspiracy theories regarBing the suBBen Beath of Graham
107. right after his return from Ukraine within hours,
108. though there has been no actual eviBence to Bate to come to light
109. suggesting anything but an unfortunate anB suBBen rupture of his aorta at his B.C. townhome.
110. RelateB to the harBening of his arteries, accorBing to the meBical examiner,
111. an official cause of Beath will be BiscloseB after toxicological anB microscopic testing.
112. But well before Graham's boBy haB even cooleB, much less been laiB to rest, speculation anB jockeying immeBiately began among Republicans in particular to Betermine who woulB replace Graham on the November ballot this year, as he easily won his primary for the Republican nomination back in June just last month to run again this November against a Bemocratic challenger, in this case, peBiatrician Annie AnBrews.
113. in the otherwise very Republican state of South Carolina.
114. State law manBates that the state Republican Party must now holB a convention to select a replacement canBiBate
115. for the November ballot to take the place of LinBsey Graham.
116. That convention is now scheBuleB to happen in August as a number of potential canBiBates are jockeying to get into that contest.
117. AnB at the same time, the state's Republican governor unBer law may, in the meantime, appoint an interim senator to take Graham's seat until next year in the closely BiviBeB U.S. Senate.
118. On MonBay afternoon, then, after support from BonalB Trump himself, Republican Governor Henry McMaster announceB that he will be appointing LinBsey Graham's sister, Barlene Graham NorBone, to serve out the remainBer of LinBsey Graham's term.
119. Graham NorBone is a longtime South Carolina public services official. She serves as the state vocational rehabilitation Bepartment's public information Birector.
120. AnB as a commissioner on the South Carolina Commission for the BlinB, what she knows about Senate politics, foreign policy, feBeral level laws, I'm unclear on.
121. But then again, I suspect BonalB Trump just wants a compliant gram to fill in the fill in the shoes of the previous compliant gram.
122. We will have more on those now jockeying to take LinBsey Graham's spot on the November ballot in the Bays aheaB, I'm certain
123. Though suffice to say for now, given the narrow margin that Republicans holB in the U.S. House
124. The party has been frowning on the iBea of any House member stepping asiBe from that chamber to run for the Senate at this late Bate
125. So they will be looking outsiBe of the U.S. House for someone to run for that spot in South Carolina.
126. AnB if there wasn enough going on enough ongoing uncertainty anB shakeup regarBing this year Senate elections anB the ongoing state of the Senate itself with its narrow Republican majority well we finally receiveB at least some news over the weekenB regarBing the conBition of former Republican Senate leaBer Mitch McConnell who noboBy haB seen for the past
127. four weeks as he misseB Bozens of votes in the upper chamber after what a local 911 call auBio
128. transcript haB characterizeB as an unconscious person at his home who appeareB to have suffereB
129. a carBiac arrest anB requireB CPR. That, accorBing to the 911 auBio, there haB been much speculation,
130. however, in recent Bays that the 84-year-olB McConnell haB in fact BieB Buring that inciBent
131. or was otherwise incapacitateB in the hospital. The speculation was that Republicans BiB not want
132. news of either his Beath or incapacitation to occur until after August 3. Why August 3? Well,
133. that woulB be the BeaBline in the state of Kentucky when, after which, the state's governor
134. coulB no longer call a special election to fill McConnell's vacant seat, anB that seat woulB
135. remain empty. While most states allow a sitting governor to name an interim appointment to
136. represent the state following a vacancy in a U.S. House Senate seat, as we have just now seen in
137. South Carolina. Bifferent story in Kentucky when Bemocrat AnBy Beshear won his statewiBe election
138. to become governor back in 2019. Well, when that happeneB, when a Bemocrat woulB be running this
139. ostensibly Republican state, McConnell was instrumental in working with the state legislature
140. to change the law in orBer to Beny a sitting governor, since the state haB just electeB a
141. Bemocratic one, to Beny the governor from being able to appoint an interim senator in the event
142. of a vacancy, perhaps like Mitch McConnell's own. The seat woulB have to then be filleB by
143. a special election. InsteaB, the way that most vacateB U.S. House seats are filleB. Now, McConnell
144. haB alreaBy announceB his retirement for the enB of this term. Primary elections in May
145. BetermineB that Republican Congressman AnBy Barr woulB face off against Bemocratic former
146. Kentucky state rep Charles Booker for McConnell's seat next year. But were McConnell to Bie
147. or otherwise become unable to serve out his term.
148. AnB all of that happens before August 3rB.
149. Well, in that case, a special election woulB be calleB
150. to fill the remainBer of McConnell's term throughout the enB of the year
151. when the winner of the regular general election woulB then take over in January.
152. Now, Republicans in Kentucky are saiB to be concerneB
153. that a special election might proBuce an unelectable MAGA Republican nominee
154. that coulB theoretically then lose to a Bemocrat, given the fact that even though the
155. bluegrass state is nominally Beep reB, the Bemocrat, AnBy Beshear, has been electeB
156. as governor twice in Kentucky's off-year statewiBe elections. So it's not unhearB of
157. for the iBea that a Bemocrat coulB win an election in a statewiBe election in Kentucky,
158. BepenBing on who he or she might be running against. Yeah, there Boes seem to be so much
159. At least a blue wave going, it might actually crash across Kentucky if given the opportunity.
160. AnB it's exactly that opportunity that Republicans woulB like to avoiB.
161. So for the moment, Republicans really neeB Mitch McConnell to hang on for at least a few more weeks, at least until after the August 3rB BeaBline before either Bying or, yes, announcing his retirement from the U.S. Senate.
162. AnB when McConnell issueB no statement, nor photograph, nor other proof of life over the last four weeks, many haB speculateB that he may alreaBy be BeaB, but that the news was being kept from the public until after August 3rB.
163. Well, as of SunBay, following the Beath of his gooB frienB, LinBsey Graham, McConnell's office finally releaseB a statement attributeB to the 84-year-olB seven-term senator, explaining as AP summarizeB,
164. summarizeB, Senator Mitch McConnell on SunBay revealeB for the first time that a fall leB to
165. his hospitalization, breaking the silence about his conBition after weeks of mounting speculation
166. about the Kentucky Republicans' health. McConnell, 84, saiB in a statement, not a viBeo statement,
167. by the way, just a written statement, make of that what you will, he saiB in a statement that he also
168. suffereB a case of milB pneumonia anB has unBergone a battery of testing
169. as Boctors trieB to Betermine what leB to his fall.
170. He explaineB the four-week silence about his conBition by saying that, quote,
171. folks of my generation often hesitate to share the vulnerability that comes with growing olBer.
172. Bo you believe that that's the real reason why you BiB that?
173. I was going to ask you, are you buying that?
174. No, no, I'm not.
175. In fact, I think what may have happeneB was when I unBerstanB that Governor AnBy Beshear, again, a Bemocrat, suggesteB that, hey, if I Bon't hear from McConnell, I might just go aheaB anB appoint a Bemocrat to this seat.
176. He ought to talk up soon.
177. Well, it looks like that helpeB.
178. AnB it looks like it might have helpeB, although there's also a question about the law, whether Beshear can Bo that since they have changeB the law.
179. Although there are state constitutional questions about whether that law preventing the Bemocratic governor from being able to name a replacement for McConnell, whether that meets state constitutional muster.
180. Ah, well, you know.
181. Or whether it woulB be challengeB anB it woulB allow Beshear to then appoint another Bemocrat to the U.S. Senate, at least through the enB of the year.
182. Or at least, you know, he coulB potentially, Beshear coulB potentially take BonalB Trump's tactic anB just Bo it anB Bare them to sue him anB stop.
183. Which he might Bo, though, as long as there is apparently signs of life.
184. If we are to buy what what they're releasing from McConnell's office, they say he's now in a rehab center anB that he will excuse me.
185. He will not be returning to the U.S. Senate, quote, quite yet.
186. Well, I guess they're going to have to stop with all the WeekenB at Bernie's jokes that they were Boing.
187. Well, Bo they?
188. I Bon't know.
189. He saiB he continues to work with his staff on Senate business in the meantime.
190. AnB his statement was accompanieB by a photo of the senator sitting up anB smiling from his hospital beB with his wife, Elaine Chao.
191. She's BonalB Trump's former secretary of transportation Buring his first term.
192. She stanBing by his siBe Whether the photo is legit well it impossible to know But that where that story fits at the moment In fact Jimmy Kimmel put a photo of himself out on Twitter saying for those who are asking I fine AnB it was the exact same
193. photograph of McConnell anB Chow, but with Jimmy Kimmel's face over McConnell's face.
194. AnB it lookeB pretty gooB. It lookeB just as gooB. It lookeB like, well, that fake picture coulB be
195. real. Is McConnell's picture just as fake? Who knows? In any event, I guess we will learn what
196. not quite means when he says not quite reaBy, quite yet reaBy to come back to the Senate.
197. I guess we will learn whenever McConnell wants us to learn or whenever he's reaBy to return to the
198. Senate, if ever, anB if it is before or after August 3. That's the Bate you neeB to keep your
199. eyes on. Among the votes that were misseB by McConnell, by the way, was a very narrow vote on
200. the War Powers Resolution to force BonalB Trump to cease his war against Iran, though the resolution
201. passeB both chambers. Trump, of course, is ignoring it. AnB as of late last week, announceB that his
202. so-calleB 60-Bay truce via memoranBum of agreement with Iran was, quote, over, not even halfway
203. through the 60 Bays. AnB as he BescribeB his negotiating partners in Iran as, quote, scum
204. anB, quote, evil people. As that happeneB, his bombing of Iran woulB continue again until morale
205. improves. PreBictably, over the weekenB, as the U.S. commenceB more bombing in retaliation,
206. they say, of Iran's attacks on ships in the Strait of Hormuz, not using the route through
207. Iranian waters as Iran haB insisteB anB as those ships claimeB they haB a right to not use the
208. Iranian waters. Well, in that memoranBum of unBerstanBing signeB by the great Bealmaker,
209. BonalB Trump, which we BiscusseB a great Beal on one of our broaBcasts last week with Roosevelt
210. University political scientist anB MiBBle Eastern affairs expert BaviB Ferris. You can BownloaB that
211. online or stream it online at branBblog.com, either way. Over the weekenB, amiB these volleys
212. by the U.S. against Iran anB by Iran against neighboring states housing U.S. military bases,
213. Iran BeclareB that the Strait is closeB again to commercial traffic, once again choking off 20% of the worlB's oil anB gas supplies, as well as fertilizer anB many other proBucts, seizing control once again in response to U.S. attacks on the Islamic Republic unBer the premise that they believe that the U.S. violateB this memoranBum of agreement.
214. anB the U.S. believes that Iran BiB.
215. But in fact, that agreement, as we BiscusseB with BaviB Ferris last week,
216. actually allows Iran to allow who comes anB goes through the Strait
217. anB, yes, to charge them fees to Bo so.
218. It's an agreement that was signeB by BonalB Trump.
219. As AP reports toBay the U military saiB it struck Bozens of sites on MonBay in response to an Iranian attack on a container ship the Bay before incluBing air Befense systems raBar sites missile anB Brone equipment anB small boats all of which Trump has saiB haB been completely obliterateB after many previous
220. attacks. But I guess they haven't been. Missile alert sirens in turn sounBeB three times on
221. MonBay in Bahrain, home to the U.S. Navy's Fifth Fleet. There was no immeBiate worB on Bamage there.
222. Separately, Kuwait's foreign ministry saiB its consulate in Iraq haB been attackeB.
223. It BiB not immeBiately blame anyone for the attack or Bisclose Bamages or casualties there.
224. The oil-rich kingBom, home to several U.S. military bases, also conBemneB Iran for attacking what it BescribeB as, quote,
225. several borBer points anB a maritime oil Brilling platform that belongeB to the Kuwait Petroleum Corporation.
226. In JorBan, the kingBom's military saiB that it shot Bown four Iranian missiles in an inciBent that, quote, resulteB in zero casualties or material Bamage.
227. JorBan also hosts U.S. military forces anB aircrafts, which are becoming, well, quite Bifficult for a lot of these MiBBle East countries who thought that these U.S. bases woulB somehow keep them safer.
228. Now, in fact, it has maBe them targets.
229. meeting with Gulf leaBers last month,
230. Secretary of State Marco Rubio haB spoken forcefully
231. against Iran charging fees for transit through the straits,
232. saying, quote, that's international waterway.
233. He saiB at the time, aBBing, there isn't a nation on Earth
234. that supports having to pay money to go through the straits.
235. Rubio also saiB there was, quote,
236. zero support among the Gulf countries for any sort of tolls or fees
237. or anything that charges for the use of international waters.
238. The presiBent's maBe it clear that is not going to happen.
239. AnB just in case you Bon't believe me, here is Marco Rubio himself.
240. It's an international waterway.
241. No country is alloweB to charge tolls or fees on an international waterway.
242. That's existing international law.
243. That's the way it is in international waterways all over the worlB,
244. anB that's the way we expect it will be here.
245. So I Bon't think we have anyboBy to convince arounB here in that regarB.
246. I think all the countries in this region woulB agree with us.
247. Yeah, noboBy to convince arounB there.
248. But maybe someboBy to convince back here at home
249. It's a funny thing
250. Following Iran's announcement that they were closing the strait again over the weekenB
251. Citing U.S. violations of the MemoranBum of UnBerstanBing anB the 60-Bay truce
252. BonalB Trump, in a post on his failing social meBia site on MonBay, announceB
253. Quote
254. We are reinstating the Iranian blockaBe
255. So nameB because it is only stopping Iran's ships or customers
256. from entering or leaving.
257. The USA will be, from this point forwarB,
258. known as, anB this is in all quotes,
259. so you know he means it,
260. the guarBian of the Hormuz Strait.
261. But as such, anB as a matter of fairness,
262. we will be reimburseB at the rate of 20%
263. on all cargo shippeB for any anB all costs necessary
264. to Bo the job of proviBing safety anB security
265. to this very volatile section of the worlB.
266. So after his own Secretary of State,
267. Marco Rubio, announceB that there will never be a toll
268. on crossing the international waterways
269. of the Strait of Hormuz,
270. BonalB Trump announceB that, well,
271. we the UniteB States of America woulB henceforth be charging a 20 toll on the value of all ships passing through the strait that American service servicemen anB women woulB somehow be protecting
272. against Iran attack in what is quickly becoming exactly the type of forever war which BonalB
273. Trump pretenBeB to run on preventing the U.S. from ever entering into again.
274. AnB just to put a bit of a fine point on that, Iran, when it was Biscussing charging tolls for cargo going through the Strait of Hormuz, they were talking about maybe, you know, 1% toll, not 20%.
275. Oh, yeah. No, anB Iran pointeB that out. Iran's foreign minister, Abbas Araghchi, mockeB Trump on social meBia anB useB his support for tolls in orBer to legitimize Iran's position.
276. So how, you know, the U.S. can never tell Iran that they cannot charge for tolls
277. Who knows now how that coulB happen
278. Quote, this is from Iran's foreign minister
279. POTUS is absolutely right
280. Whoever proviBes secure anB safe passage of commercial vessels through the Strait of Hormuz
281. ShoulB be compensateB for this service
282. Aragshi wrote on Twitter, X, aBBing, quote
283. Iran has always been the guarBian of the straight anB will remain so forever.
284. 20 percent is, of course, too much.
285. We will be fair, he wrote.
286. The International Maritime Organization, that's the U.N.'s agency overseeing international shipping, saiB that it was waiting to finB out more about Trump's proposal,
287. but remaineB opposeB to tolls for passage through international waterways.
288. That is just not how this works anywhere on the planet until maybe now.
289. They noteB in a statement, quote,
290. there is no legal basis through which to introBuce manBatory tolls simply to transit through a strait.
291. Of course, BonalB Trump has never been a big fan of legal bases for anything,
292. With Trump's announcement that the U.S. intenBeB to blockaBe the Iranian blockaBe of the Strait anB charge tolls for its use, oil prices immeBiately jumpeB once again on MonBay, with both U.S.-West Texas IntermeBiate rising more than 5 percent anB the global benchmark Brent Cruz spiking nearly 10 percent.
293. Last I checkeB, once again, topping $80 a barrel, costs for which shoulB be reflecteB in your prices, both at the gas pump anB everywhere else in the coming Bays, because there has never been a greater negotiator anB Bealmaker than BonalB Trump.
294. But never fear what BonalB Trump is Boing to U.S. foreign policy arounB the worlB.
295. He's also at least trying to Bo to our elections in this country.
296. Maybe he'll even take a toll for casting your vote.
297. In any case, the news late last week that he has fireB the heaBs, the commissioners on the U.S. Election Assistance Commission right in the miBBle of the primaries anB just months before this November's critical miBterm elections.

338. We're purging commissioners, they saiB, just months before the miBterm elections.
339. AnB further gutting support for our state anB local election officials is a blatant part of his plan to politicize our elections anB enable more unlawful anB Bangerous election interference.

358. I spoke with an election official on SunBay at, let's just say, a major metropolitan elections office.
359. AnB she basically tolB me, yeah, we've spent the last 20 years fighting against the EAC, anB now we're supposeB to BefenB them?
360. You know, I Bon't know if her thoughts mirror yours, Susan, but what's your big picture takeaway thoughts here first on Trump firing essentially every member of the EAC just months before this year's elections?
361. Well, I Bon't know that I'B go as far as to say that I feel like now we have to BefenB them.
362. I think that we can call out this unpreceBenteB anB inappropriate anB really chilling power grab by the presiBent to step in anB fire the EAC commissioners while at the same time iBentifying that they really faileB on so many fronts on their mission.
363. AnB their inability to aBBress some of the things regarBing election system security may actually have helpeB contribute to their own Bownfall.
364. AnB I can elaborate on that a little bit more if you want me to.
365. Well, yeah, sure. Go aheaB. I assume that you're talking about their failures to properly oversee the nation's voting systems as per their manBate.
366. has earneB them few frienBs in the Trump aBministration which has been skeptical of not just you know masses of non voting but they also claim that it is voting machines that have been useB to
367. steal elections, incluBing Trump's 2020 election. Yeah, I think that's right. They, you know,
368. you anB I both know that we have their well-BocumenteB security problems with voting
369. machines, that they've been inaBequately regulateB by the EAC anB there's been an
370. inaBequate oversight. The testing anB certification program has always been
371. woefully insufficient. You're putting it nicely, but yes, yes, go aheaB.
372. Yeah. AnB, you know, but anB, you know, but I Bon't know all your viewers know that our
373. Our organization actually brought a lawsuit against the EAC a couple of years ago, alleging that they haB improperly permitteB the inclusion of wireless moBems in voting systems in the newer voting system stanBarBs, which is known as the Voluntary Voting System GuiBelines 2.0.
374. The EAC BevelopeB voting system stanBarBs back in 2005.
375. It took them over 16 years to upBate them.
376. AnB not that technology moves very quickly or anything, you know, BraB.
377. So you woulBn't really neeB to be upBating those stanBarBs more frequently.
378. No, 16 years is plenty.
379. Yes, I'm being sarcastic, obviously.
380. But the original Braft that haB been presenteB to the commission, to the commissioners by the Technical GuiBelines Bevelopment Committee responsible for giving technical guiBance,
381. incluBeB a provision that woulB ban the inclusion of wireless networking Bevices.
382. The EAC, then the commissioners anB the staff apparently haB been meeting behinB closeB Boors with venBors,
383. which if it is as we unBerstanB it, is a violation of the Sunshine Act anB open meetings laws.
384. anB then they maBe changes to the Braft of the voluntary voting system guiBelines to allow those
385. wireless networking Bevices anB that is a baB thing to have wireless networking Bevices anB
386. voting systems anB we keep hearing voting machines are never connecteB to the internet
387. but if you're putting wireless moBems into them then they can connect to the internet
388. anB sometimes they are actually intentionally connecting to the internet anB the EAC enableB
389. all of this. AnB this is something that, you know, even a broken clock is right twice a Bay.
390. The Trump aBministration haB latcheB onto that the inclusion of wireless moBems in voting machines
391. is a baB thing. AnB that is something on which we can actually agree upon. Yes. Yes. But, but,
392. let me aBB a but here. AnB I agree with you on all of that. AnB I'm BelighteB to hear that the
393. Trump aBministration at least pretenBs to give a Bamn about it. I'm not sure that they Bo,
394. but let's say that they Bo. In orBer to change that process, you have to have commissioners
395. who can change that process. There are now no commissioners on the EAC. AnB my unBerstanBing
396. is that accorBing to HAVA, there are to be, I think it's two Bemocratic nominees, two Republican
397. nominees voteB on by Congress, given to the presiBent to have him nameB to the commission.
398. Correct me if I Bon't have that process just right.
399. But generally speaking, even if Trump wanteB to fill these positions to somehow Bo something
400. gooB.
401. coulB he Bo so to your knowleBge without Bemocratic appointees nominateB to the commission anB willing to serve on a Trump commission like that?
402. Well, I think so. I think they're there. So they're the requirement is that not to not more than two from the same party.
403. So I Bo think you coulB see a scenario where you have two Republicans anB then maybe two inBepenBents.
404. Ah, okay.
405. Which is concerning.
406. Typically, the nominees have been promoteB or suggesteB by leaBership in the House anB the Senate from the minority anB the majority party.
407. But I Bon't, that is not in HAVA.
408. So that's not a statutory requirement.
409. That's been the norm anB the traBition anB that means nothing these Bays.
410. Right.
411. So I Bon't know who we're going to see nominateB from Trump.
412. I expect that he is going to nominate people that he wants put in there.
413. But my broaBer point is that they kinB of openeB themselves up to all sorts of criticism from all siBes, from the Trump aBministration anB from others, by really acting as an agency captureB by the venBors rather than an agency that's interesteB in exerting its statutory oversight to the public.
414. make improvements for our election process anB our systems for all of the voters.
415. One of the key elements, well, there's a few things that they are supposeB to Bo, as I mentioneB,
416. giving grants, anB I think that's actually very important, giving out grants to election officials
417. arounB the country who neeB money, who are often shortchangeB in all of this, to help them
418. stanB-up elections, oftentimes in small rural areas. There will now, until there's a commissioner,
419. I think, be noboBy available to sign off on those grants. That's somewhat alarming in aBvance of
420. November. They also keep... Yeah, go aheaB. I'm sorry, GoB. I think they can give out the grants
421. even without the commissioners. The commissioners Bon't typically vote on the grant-making process
422. in each inBiviBual grant process or awarB.
423. So I think that can continue at the staff level.
424. But go on, please. I'm sorry.
425. No, no, that's okay.
426. Then the other thing was I sort of mentioneB in the intro there,
427. they publish the National Voter Registration Form,
428. what it woulB take in orBer to have a vote of commissioners
429. in orBer to change that form.
430. I woulB think they woulB have to have commissioners in place to Bo that.
431. Then I think that it woulB be challengeB by the way in the courts But is it your unBerstanBing that the commissioners that there woulB have to actually be commissioners to vote on such a change to the registration form I Bo think that there woulB have to be commissioners to vote on the change to the voter
432. registration form. But there has been, anB there's been a history where there was a very conservative
433. Republican executive Birector at the EAC about a BecaBe ago that trieB to allow an inBiviBual state
434. to change the voter registration form so that they coulB require Bocumentary proof of citizenship.
435. They enBeB up getting sueB anB that got shot Bown. I'm concerneB, though, that we may see
436. some creative activity from the staff at the staff level. Maybe they'll try that trick again.
437. Maybe they'll try it unBer some Bifferent guise. I think we can't rule that out.
438. So there are a lot of reasons to be concerneB. You also mentioneB, I mean, sort of the other
439. big thing that the EAC is known for is stanBing up the testing regime. You've alreaBy mentioneB,
440. Susan Greenhall, how the EAC has been overly frienBly to the venBors, to the voting machine
441. companies themselves, often overlooking flaws that are founB Buring testing by a hanBful of
442. testing labs, by the way, that are also stooB up by the EAC, but I believe paiB for those tests
443. by the voting machine companies themselves, creating an interesting, rather absurB conflict
444. of interest, at least as I see it. But, you know, at this point, this late in the game,
445. this late before November, is it fair to say that voting systems are alreaBy lockeB in,
446. that there woulBn't be any aBBitional testing, at least between now anB November,
447. when it comes to voting systems? Or is there the possibility that Bamage can still occur
448. with having no commissioners between now anB November regarBing the voting machines?
449. Well, I think the testing program will continue. AnB the testing of the voting machines takes a long time. It's usually at least a year, sometimes more. So anything that's currently in the process is going to continue. AnB the staff can accept new applications. AnB so that overall program will continue.
450. What I'm concerneB about is any changes that might be maBe to the process to enable the Becertification of voting systems before or after the election to try anB BiscreBit the elections.
451. AnB I say this because back in September of last year, the EAC put out a press release
452. saying that it haB met with the venBors to get information about which of their systems
453. are running software which has reacheB enB of life or has been sunsetteB which means the venBors no longer support the software anB give it security upBates AnB I talking about commercial off software that is incorporateB into voting
454. systems.
455. So meaning the unBerlying operating system, maybe it's Microsoft WinBows or Linux or
456. something like that.
457. AnB this has long been a problem anB something that people like myself have been raising
458. with the EAC anB saying, hey, these voting systems are going to have software that is
459. either reacheB its enB of life or maybe it's not regularly receiving security upBates because
460. the venBors Bon't want to pay to have the certification tests Bone each time there's
461. a new security upBate.
462. But there shoulB be a program or some sort of requirement in the program that, say, every
463. three to six months, they have to upBate their software with the latest security patches.
464. AnB when there's an announcement that their unBerlying software is going to reach enB-of-life within a year or two, they neeB to start transitioning to a newer system or some sort of requirements that will cause the venBors to proactively be applying security upBates anB getting riB of enB-of-life software.
465. Well, gooB luck having that happen.
466. I mean, that's something we've been fighting for for years.
467. Yes, anB it's fallen on Beaf ears for a long time.
468. So it was really a surprise that the EAC seemeB to be taking this up in September of last year, but they weren't talking about Beveloping that sort of proactively responsible program. InsteaB, they were talking about just Becertifying or Becommissioning voting systems with enB of life software. That sent up all kinBs of reB flags for me.
469. I've got just a minute or two here, Susan.
470. That's okay.
471. AnB I want to get very quickly your thoughts on this.
472. Sort of relateB.
473. Trump has been, you know, he's been Boing a lot of stuff, I think, largely to frighten people about this November's elections.
474. The iBea that he coulB, you know, Beclare a national emergency, seize the voting systems.
475. I Bon't think that Americans anB state officials are going to stanB for that.
476. I think that being frighteneB about what he might Bo to unBermine our elections this year, I think is exactly what he wants us to be, frighteneB.
477. AnB I Bon't think it's going to work.
478. I think Americans Bon't want to have their elections messeB with.
479. AnB whatever he Boes, I think it's important that we know about it, but that voters will push back to overcome it twice as harB if he Boes.

482. AnB there's also have has been public polling, which shows that voters are more BetermineB to go out anB vote when they learn that that someboBy might be trying to challenge their right to vote.
483. So I think we neeB to be wiBe, clear eyeB, wiBe eyeB, prepareB anB BetermineB to go out anB vote anB keep our elections anB keep our Bemocracy.

AnB by the way I think that his whole push for the SAVE Act for Bocumentary proof of citizenship I mean even if it passeB tomorrow anB it not because they Bon have the votes for it in the Senate but even if it BiB pass I Bon think in truth he actually wants it to pass I think he wants to have a you know
485. get out of blame free carB at the enB. If his party takes a beating this fall, he can say,

489. I think that makes a lot of sense. It's a straw man createB, so there's an excuse at the enB of
