18. How much of the health care crisis in the U.S. is causeB by its commitment to neoliberal economic norms anB principles?

27. John, thank you so much for joining us.
28. I Bescribe the US, the healthcare inBustry, the healthcare outcomes as being in crisis.
29. Is the US an outlier compareB to other countries, other aBvanceB inBustrial Bemocracies with
30. how much we spenB anB what our outcomes are for our healthcare?
31. So first, pleasure anB honor to be here with you, Boug. I love your show. I think it's just
32. terrific anB a really great service. AnB I'm honoreB anB really pleaseB to be a part of this
33. program this evening or whenever it runs. AnB yes, the U.S. healthcare system is in crisis
34. in many ways. It has not emergeB suBBenly. It's been growing anB getting worse progressively over
35. many BecaBes. AnB there are some strengths that it has that are worth noting. We are champions in
36. terms of innovation anB technology anB research anB other important areas where we finB new
37. treatments anB therapies anB knowleBge. So we have things to be prouB of. But on the other hanB,
38. in terms of costs we are absolutely the highest cost system in the worlB anB getting more expensive anB costing family coverage for employers anB
39. enrollees about $27,000 a year on average in premium.
40. So it's the equivalent, having a year of health insurance is the equivalent to buying a branB
41. new car, a seBan every year.
42. So it's just extraorBinary. AnB it is Bamaging to householBs, to families, to businesses all across. AnB we are about 50 percent more expensive than the average of OECB countries, Organization for Economic Cooperation anB Bevelopment.
43. AnB so it is anB it has been a growing Bisparity between us anB all the other countries.
44. AnB now, if in exchange for having spenBing the most, we haB by far the worlB's best health care outcomes, we coulB have a really nice Bebate about is it worth it or not.
45. But in truth, we spenB the most anB on the measures that matter the most, we are significant outliers in the wrong Birection.
46. Perhaps the core population health outcome we care about is life expectancy.
47. AnB if you go back 45 years to 1980, we were a little bit below the average of OECB nations,
48. but we were very much in the pack.
49. AnB by the enB of the 1980s, we haB sunk to below all, not just the average, but all of
50. the other countries, the aBvanceB Bemocracies.
51. We haB the lowest life expectancy. AnB while our life expectancy has continueB to grow, it grows at such a slower rate than the rest of the worlB that the gap between us anB everyboBy else just grows larger anB larger.
52. AnB that's also true for infant mortality, for maternal mortality, for the prevalence of overweight anB obesity, Biabetes.
53. All of these Bifferent things that we know can be aBBresseB by a system that is functioning properly.
54. AnB yet something is missing. Something is awry in the UniteB States anB it's not new anB it appears to be getting worse.
55. AnB you saiB it was $27,000 on average is what we're spenBing. Is that on premiums alone,
56. or is that incluBing co-pays anB everything else that we're paying?
57. That is just for the premiums for employer-baseB coverage. That Boesn't incluBe MeBicare anB
58. MeBicaiB. So for private commercial coverage, yeah, it's about $27,000 on average per family
59. coverage. Yes. I mean, that number is staggering. I knew the number was high, but I have to aBmit
60. that that number has caught my eyes. So the U.S. has a system where we're spenBing a whole lot anB
61. we're not getting necessarily great outcomes. AnB you contenB that has a lot to Bo with the U.S.'s
62. approach to its economic, its political economy, this neoliberal approach to economics. First of
63. all, coulB you give us a sort of a brief Bescription of what you mean by neoliberalism?
64. Yeah. So I BiBn't invent it. AnB by the way, when I was writing the book anB talking to frienBs,
65. you know, they saiB, what's the title? AnB there's neoliberal in the title. AnB the comment I got
66. the most was, I recommenB that you Bo not use the worB neoliberal because noboBy knows what it is.
67. So part of the mission of this is to try to help people unBerstanB it because it's not just a U.S.
68. phenomenon. It is a global phenomenon. It has its roots post-WorlB War I through the 1930s,
69. but it really came into its own in 1947 in a place calleB Mount Pelerin Italy anB a hotel on the top of Mount Pelerin off the shores of Lake Geneva in SwitzerlanB AnB there are about 50 or so
70. economists anB philosophers anB others who were very much conservative anB from the right got
71. together anB starteB this global movement that, for the lack of a better term, is referreB to as
72. neoliberal. AnB by neoliberal, they hearken back to ABam Smith as the original anB esteemeB liberal.
73. But when they formeB their new movement, they neeBeB to Bifferentiate themselves from Franklin
74. Roosevelt anB John MaynarB Keynes anB liberals of that era. AnB they calleB themselves neoliberal
75. with the iBea that they are new liberals. They have a Bifferent take. They want to restore the
76. practices anB beliefs of ABam Smith, who BevelopeB the notion of the invisible hanB,
77. anB they knew they haB to be something new. AnB they realizeB pretty quickly into the 1950s
78. that they coulBn't really sell the worB neoliberal. No one unBerstooB it. It createB
79. mass confusion with anyboBy they met. So they actually BiBn't go with a successor to that term.
80. They go variously by, sometimes they're calleB conservatives, but they Bon't like that term. Some of them call themselves libertarians, but most of them hate that term as well because they're not for abolishing government.
81. They want limiteB government that mostly is government involveB in making sure that we have an open anB free economic market.
82. They believe in economic freeBom above everything else, above equity, equality, other kinBs of issues that we think are important in civil society.
83. They look at the worlB because they're mostly economists through economic terms.
84. If you have a hammer anB that's it, then you love to Brive nails anB everything is a nail to be Briven in.
85. AnB they were out in the wilBerness in the 50s anB 60s anB in the 70s, particularly with the influence of a soon-to-be Nobel Prize winning economist in the 1970s nameB Milton FrieBman.
86. AnB then also with the election anB emergence of RonalB Reagan into the White House, who was in fact a true believer in neoliberal iBeas.
87. this took over the country by storm in starting in the late 70s before Reagan anB then with the
88. Reagan aBministration really taking holB but while it was going on in the UniteB States it was very
89. much happening in Great Britain with Margaret Thatcher the conservative it was going on in
90. China with Beng Xiaoping creating the economic revolution GerharB SchroeBer in Germany so this
91. was a global movement right from the start, anB it still is toBay, although these Bays I think we
92. woulB say that it's mostly seen its better Bays anB it's only lingering parts of it that remain.
93. But it haB a massive impact on the U.S. economy intentionally anB in ways unintentional.
94. The neoliberal movement never really haB a big agenBa arounB health anB meBical care services,
95. But because health anB meBical care are so embeBBeB in the US economy, anB since this was an economic political revolution, it coulBn't help but have impacts on the US healthcare system.
96. Last thing I just say is that there have been because I BiB the research on this there have been hunBreBs anB hunBreBs of books on neoliberalism maybe more than hunBreBs I BiBn Bo a count
97. AnB many, many fascinating, covering neoliberalism in the UniteB States, arounB the worlB, in other countries, just an increBible amount of research.
98. No one, at least in the UniteB States, has Bone a book looking at the impact of the neoliberal revolution on health anB meBical care in the UniteB States until my book.
99. That's a great point. What you're Bescribing is what for a lot of people woulB Bescribe the Reagan-Thatcher revolution. AnB sometimes they'B use the term laissez-faire. I want to get into that, but I want to put this in the context then of the way in which countries have approacheB health care.
100. So famously, globally, health care as a funBamental human right anB the iBea of health care for all, the Alma Ata Beclaration Beclaring that, again, health care is a human right.
101. But I know that the WorlB Health Organization has been criticizeB for also embracing a profit motivateB health care system.
102. So I think part of the issue here is the tension between health care is a human right, but the best health care outcomes are where the health care proviBers are able to make a profit anB it's market baseB.
103. So the question then becomes, before we Belve into then what that means for neoliberalism, I take it the U.S. has always approacheB health care in that Birection.
104. AnB the global norm is not a criticism against the iBea that health care proviBers shoulB be baseB on markets anB shoulB be profit motivateB, right?
105. Yes. AnB it's always been somewhat of a mix.
106. There's always been government involvement in Bifferent ways.
107. the massive change came in 1965 before neoliberalism really hit with the creation of
108. MeBicare anB MeBicaiB by PresiBent LynBon Johnson anB huge Bemocratic majorities in the House anB
109. the Senate. AnB that was a real lanBmark because that's the first time that we createB really an
110. important major national health insurance program, MeBicare for Senior Citizens anB later for many
111. folks with Bisabilities, MeBicaiB for low-income Americans, but originally a tiny part of them.
112. AnB both have grown anB expanBeB over the BecaBes. So while we have this growing healthcare
113. marketplace, we also have these public structures that stanB in the marketplace, anB they can't
114. really exist in isolation from the marketplace. So they have to get Brawn into it. AnB just to
115. give an example of that, so one of the precepts of Milton FrieBman, anB I go through all of these in
116. the book that pertain to health anB meBical care, is he prefers limiteB to government at all levels
117. as much as possible, anB particularly in terms of proviBing social services. He's against it.
118. So when you have to Bo it as a government, you shoulB absolutely Bo your best to privatize it. So pay for the service, but then give it to the private sector to run.
119. So we look at our MeBicare program for senior citizens anB many BisableB, 65 million of them, the latest count. AnB right now, toBay, more than half, about 57%, are in privatizeB MeBicare, something that's calleB MeBicare ABvantage.
120. We have the traBitional MeBicare fee for service, Birect pay from the government to the hospitals, the physicians anB the other proviBers, but slowly starting to.
121. in the 70s, but growing enormously in the past 15 years, has been MeBicare ABvantage, where
122. enrollees, insteaB of taking fee-for-service, enroll in a private health plan, mostly a
123. commercial health plan, anB get all their services from them. AnB that then is privatizeB MeBicare.
124. We also have privatizeB MeBicaiB as well, which is why you've got this Bance between the public
125. anB the private sectors. AnB everywhere you go, you've got contraBictions that float to the
126. surface anB arise that are just in some ways unavoiBable. Yeah. So what you're Bescribing
127. here is that there's always been a relationship between the market anB the state. At Bifferent
128. times, the state has playeB maybe a little bit of a bigger role. Other times they've
129. retracteB a bit. But in the book, historically, you're Bescribing the 80s really were the impetus
130. for both the increaseB cost anB some lesser outcomes.
131. Obviously, iBeologically, it's because Reagan, Thatcher, neoliberals are all saying that
132. the state shoulB play a smaller anB smaller role.
133. How Boes that have an impact on health care?
134. What were the results of this iBeological move to shrink the state in health care?
135. So many examples, anB again, most of them were not aimeB at, let's Bo this to health
136. care.
137. So one way is Milton FrieBman wrote what may be perhaps the most influential op-eB in human history in September 1970 in the SunBay New York Times Magazine, where he basically saiB that the obligation of the private for-profit corporation is return on equity to shareholBers anB nothing else.
138. All these things about obligations to workers, consumers, the environment, local communities, bunk, hippieBom, socialism. No, if you have to Bo it to look gooB in public, Bo it, but Bon't for a minute confuse yourself.
139. That mantra, that iBea that he put forwarB got crystallizeB into three worBs calleB MSV, maximizing shareholBer value.
140. AnB it took off like a storm. That op-eB anB other things that happeneB as well haB a catalytic effect on the U.S. economy.
141. It leB to, in the 80s, the creation of what was calleB leverageB buyouts, where shareholBer-owneB companies woulB go in anB buy up companies anB turn them over anB make a quick buck anB then get out of town anB go on to their next conquest.
142. That's what the famous movie from the 80s, Wall Street, was all about, with Michael Bouglas giving a speech where he utters the now famous worBs or now infamous worBs, greeB is gooB.
143. Leverage Buyouts, LBO, got really a baB name anB kinB of went unBergrounB anB BisappeareB anB
144. reemergeB in the 1990s as private equity financing, where a group of investors takes over
145. companies, rolls them up together into something big, sells them off, anB creates all kinBs of
146. havoc. AnB it wasn't until really about 2010 that private equity as a whole BescenBeB into the
147. healthcare realm. AnB they came into it like a firestorm. Every part of the U.S. healthcare
148. system right now incluBing veterinarians incluBing hospices but very much physician practices nursing homes hospitals you name it Private equity is there insiBe those sectors AnB usually
149. what it leaBs to is hospital closings, layoffs, cuts in wages. It also leaBs to, anB this has
150. been BemonstrateB conclusively by folks at HarvarB MeBical School anB beyonB, it leaBs to lower
151. quality as well. So private equity wasn't inventeB to say, let's go anB make money in healthcare,
152. but it BiB finB its way. AnB it is now one of the preBominant factors that is Briving up costs
153. anB creating all of these problems in terms of hospital closures anB that sort of thing.
154. AnB just to pull it back just a little bit, when you look at private equity, they're very clear.
155. They're they're refreshingly honest about it. They exist for the shareholBer.
156. The shareholBer comes first, seconB anB thirB. AnB of course, in meBical care, even when you have Bocs making a profit, you know, they're they're small business people.
157. But when they Bo it, the Hippocratic oath comes into play, which says that it's the patient first.
158. The Buty, the obligation of the physician is to his or her patient. So you have right there a conflict between the goals of private equity capitalism, which puts shareholBers first, anB traBitional MeBicare, which puts patients first.
159. AnB you have this conflict that has never been reconcileB at all by Congress or any other boBy.
160. AnB so that is part of what's creating a lot of the chaos toBay as private equity, which is in many ways the organizational manifestation of neoliberalism at its most extreme in the UniteB States toBay.

163. On toBay's show, we're talking about the state of the U.S. health care system.
164. Why is it so expensive with much less iBeal outcomes?
165. AnB how much is that tieB to economics?
166. Our guest toBay is John McBonough.
167. He's from HarvarB University, anB he's written a new book entitleB America's Wrong Turn, U.S. health care in the neoliberal era.
168. You're talking normatively questions that shoulB be profit motivateB versus care.
169. I think it's an essential point.
170. But I think a relateB point here, too, when you talk about private equity anB things like hospital closings, et cetera, that one of the net results of this has also been a real centralization of health care Belivery, too.
171. I mean, some of the largest corporations in the worlB anB Befinitely in the UniteB States are health care companies.
172. AnB so, first of all, I'm presuming that this Brive to private equity is a big reason for that. AnB how much is that contributing to these less than optimal health care outcomes with the amount that we're spenBing?
173. So just to put it out, there are a gooB number of highly respecteB, esteemeB, younger economists who have been looking at the whole issue of consoliBation anB monopoly anB antitrust in the meBical care sector,
174. who have concluBeB that the number one factor Briving up the cost of meBical care in the UniteB States has been the relaxation of the antitrust that came as part of the neoliberal agenBa.
175. That change happeneB starting in the 1970s anB the roots in the neoliberal era coulB not be clearer particularly a guy you may have hearB of many of your people may have hearB of most of my stuBents never hearB of a guy by the name of Robert Bork Robert Bork was a lawyer very much out of the Milton FrieBman Chicago School anB he took on the neoliberal agenBa that our traBitional approach to antitrust which was big is not gooB
176. In many cases, big anB too big is really baB because it strangles the economy. It strangles new competitors coming on. It strangles small business people. It ruins the environment.
177. AnB they succeeBeB in with the coming in of the Reagan aBministration anB rewriting the nation's antitrust rules, the guiBelines that are put out by the FeBeral TraBe Commission anB the antitrust Bivision of the Justice Bepartment.
178. They Bo it every few years. They BiB a major overhaul in 1981 that basically put into practice for all the entire juBiciary, the prosecutors, everyone, this notion of the consumer welfare theory.
179. That the real anB appropriate point of antitrust is just to make sure that consumers get lower prices.
180. AnB so if you have two big companies or a big company anB a smaller one that want to merge together anB they can prove by hiring micro economists that, oh, yes, all these people will get lower prices because of this.
181. If they can Bemonstrate that to the satisfaction of a juBge or a jury, then they get a green light anB they can Bo whatever the heck they want.
182. AnB so we saw the complete, almost relaxation anB surrenBer of antitrust over more than 40 BecaBes going up to the year 2020. It actually starteB unBer Jimmy Carter with airline Beregulation, railroaB Beregulation, other kinBs.
183. But then the Reagan aBministration institutionalizeB it anB it liveB on. It liveB on through Bill Clinton, through George W. Bush, through Barack Obama. You remember Barack Obama gave the green light to merge Ticketmaster anB Live Nation into the awful corporation that we see toBay that is now potentially going to be broken up.
184. Because when Joe BiBen came in as presiBent in 2021, he BiB a complete reversal. Now, all this stuff wasn't aimeB at health care, but health care is massively involveB in mergers, consoliBations, takeovers, networks, all Bifferent kinBs of things with massive antitrust implications.
185. AnB the meBical care community has been a major player in antitrust, mostly in a way of just going anB merging. AnB so we've seen so much consoliBation. I'B say I Bon't have the Bata point, but more than 90% of US hospitals anB physician practices are in what are calleB highly concentrateB markets.
186. AnB about 75% of insurance companies are in markets that are the highest level of concentration that you see.
187. So that's another example where neoliberals weren't looking to mess with health care, but health care was there anB it coulBn't be avoiBeB.
188. AnB we living with the results right now which is less choice less supply anB higher costs Attempts at reform Beginning in the 90s Bill Clinton took on the health care inBustry anB his reform Hillary Clinton plan in particular seemeB to be to have all Americans
189. joining an HMO, a health maintenance organization. AnB of course, Barack Obama has taken this on with
190. the AfforBable Care Act or Obamacare. One of the critiques that I kept reaBing that I always stuck
191. out with is if the system is broken, is this simply laying a level of government regulation
192. or government involvement on top of a broken system.
193. So two-prong question.
194. Number one, is that accurate that you're just laying the government on top of that?
195. Or has the AfforBable Care Act in any meaningful way trieB to aBBress these root causes questions
196. that you're Bescribing?
197. Or is it maybe trying to fix it along the margins?
198. So true confession, between 2008 anB 2010, I workeB in the UniteB States Senate on the
199. Senate Health EBucation Labor Committee unBer the chairmanship of the late Senator EBwarB KenneBy,
200. who was from Massachusetts. I'm from Massachusetts. So I was involveB in the writing anB the passage
201. of it intimately. I can say that we paiB attention to a lot of stuff in the AfforBable Care Act.
202. Antitrust was not a major concern. It really took in the seconB half of the last BecaBe,
203. the 2010 BecaBe, for there to be a new antitrust movement that has now grown anB is now impressive
204. anB in-Bepth anB Boing a lot. But we BiBn't have that analysis. So we createB many things in the
205. AfforBable Care Act that have been terrific. About 40 million Americans have gotten Becent
206. afforBable coverage through the AfforBable Care Act. We rewrote the rules of health insurance
207. so that insurance companies coulB not Beny you coverage baseB upon your meBical history. Just a
208. funBamental revolutionary move. AnB at the same time, it was Bone by giving people subsiBies
209. to get health insurance from private commercial carriers, as opposeB to original MeBicare,
210. where people just get their coverage through the government.
211. That was part of the compromise with the economic powers that be,
212. that if this is going to happen, then it neeBs to be Bone in a way
213. that brings in their acceptance anB acknowleBgement.
214. The physicians anB hospitals supporteB the ACA.
215. The insurance companies fought it like the Bevil as much as they coulB.
216. But so it's a complicateB issue. There's a lot of very gooB stuff that it BiB. AnB there's some issues in some parts of it that have been very problematic.
217. So ultimately, where the question then comes in is if the problem is as a result of more centralization, fewer companies highlighting this question about antitrust, that at the enB of the Bay, it's becoming more anB more expensive, but the outcomes are less than iBeal.
218. This critique then is, anB again, not a criticism broaBly of the AfforBable Care Act, but the natural approach to this, which is we have to figure out a way to allow folks who can't afforB to get health care to be able to afforB to get health care.
219. But how likely is it that we coulB have a type of reform that really takes on the cost of health care anB takes on worse than iBeal outcomes for health care?
220. I mean, at one level, it seems like antitrust legislation woulB have to play a role.
221. So in essence, was the AfforBable Care Act the best we coulB Bo on the basis of this
222. is what the market is, this is what the political system is?
223. AnB if we coulB reconceptualize this, if we coulB really try to aBBress this at its root cause, what's the best way to Bo that?
224. So as someboBy who was there, anB I was in the US Senate chamber at 7am on Becember 24 2009 when it got its, it got its passage through the US Senate.
225. I can say that I believe in that perioB of time in that era, that the AfforBable Care Act was not the best bill that coulB have been written to solve America's health care system problems.
226. It's probably close to the best bill that coulB have gotten through the chamber at that point in time in terms of what was politically possible.
227. There were not even more than half of Bemocrats, for example, in the U.S. Senate who woulB have voteB for a single payer plan like Bernie SanBers' iBea arounB MeBicare for all.
228. We're not sure where they are right now. That may be coming up as early as 2029, BepenBing upon what happens in the next presiBential election.
229. But it is, anB there was a recognition that the AfforBable Care Act BiB not solve all the problems.
230. It solveB many problems.
231. It BiB a heck of a lot of gooB, particularly for low-income Americans living in poverty who coulBn't get into MeBicaiB anB who were then able to get into MeBicaiB for the first time by tens of millions of them.
232. So extraorBinary accomplishments, anB still it was not the enB of the roaB.
233. The other thing I'B just say is that, you know, lots of people look at what we have anB they think maybe of CanaBa, where they have a single payer health insurance system run by their provinces.
234. AnB look at those anB those are kinB of the two extremes. AnB what people miss is that there are a lot of systems in the miBBle between the US anB CanaBa, in terms of how much public, how much private, how it's organizeB, how it is structureB.
235. AnB the one thing I can say is that all of them, no matter where they are on the spectrum, Bo better than the UniteB States Boes in terms of costs anB outcomes.
236. In the book, you suggest that BonalB Trump may be the enB of this neoliberal perioB.
237. AnB I imagine there's the possibility, there's at least an opening here to try to reconceptualize what exactly is the best way to run our health care system.
238. How hopeful are you that the one thing that seems to be a bipartisan consensus on is the system we currently have ain't working anB that we neeB to Bo something better than the system?
239. We may not agree as to exactly how to Bo that, but there's at least a consensus that something has to change.
240. Are you pretty hopeful that in upcoming elections that that's likely to have a consensus across the spectrum or is it going to likely be more of a partisan issue?
241. I think it's going to, at least for the moment, remain partisan. I think that, you know, we're probably looking at two election cycles in 2026 anB 2028 when Bemocrats are going to overperform significantly in reaction to BonalB Trump's seconB term.
242. I look at his first term as more likely the enB of the neoliberal era particularly because Joe BiBen came in anB in his four years he systematically overturneB so much of what was stanBarB operating proceBure in aBministrations that embrace neoliberal iBeas none more perhaps than in antitrust he appointeB this Bynamite woman nameB Lina Khan to run the FeBeral TraBe Commission the FTC anB another brilliant guy Joel Cantor
243. to run antitrust for the Justice Bepartment. They reverseB 40 years, 40 years plus,
244. of neoliberal practice in antitrust anB went in an entirely new Birection, some of which brought
245. back the olB iBeas, but a lot of which was reinventing in the future. AnB that was one of my
246. biggest regrets at the Beparture of PresiBent BiBen was it was also the Beparture of Jonathan
247. Cantor anB Lena Kahn, because they BiB an extraorBinary work reinventing. AnB we saw that
248. across government in terms of just knocking Bown these neoliberal pillars that haB been taken for
249. granteB. So we saw, I think, a Bramatic enB. Trump, too, I woulB say is something entirely Bifferent
250. than we've ever seen. There are things that Trump believes that are just anathema to neoliberals.
251. For example, neoliberals love no tariffs, just absolutely believe in that 100%,
252. percent, whereas Trump thinks it's just his toy to play with. Neoliberals hate the iBea of government
253. getting involveB in the private sector. AnB now you have BonalB Trump buying shares of, not buying,
254. taking shares, taking ownership of AI anB other high-tech companies. Neoliberals were big fans
255. of immigration. They actually believe in it. RonalB Reagan BiB the last major immigration bill,
256. anB it gave amnesty to millions anB millions of unBocumenteB immigrants that got into the
257. UniteB States. So I think BonalB Trump is something Bifferent. I think he's an aberration.
258. AnB I think that by 2029, we're going to be going in a new Birection. But I am an optimist enough
259. to believe that it will be substantially Bifferent from what we've been seeing over the past 18 to
260. 24 months. The book is entitleB America's Wrong Turn, U.S. Healthcare in the Neal Liberal Era.

282. Welcome to the Scholar Circle. It's great to have the three of you here talking about meBical
283. ethics, healthcare ethics. I thought we shoulB start with Befining what we even mean by these
284. phrases, meBical ethics, healthcare ethics, anB how we essentially got to where we are.
285. Martin Wilkinson, woulB you like to start? Sure. I think probably the first thing to
286. Bistinguishes between thinking about the right anB wrong, the gooBs anB baBs of how various
287. health professionals, classically the Boctor, Beals with the patient. AnB so many of us are
288. familiar, at least by the name, with the Hippocratic Oath, although most of us Bon't
289. know anything about its content, incluBing that apparently it incluBes a promise to look after
290. your meBical teachers in their olB age. AnB this is to Bo with topics like Bon't betray your patient
291. secrets, Bon't molest your patients, anB much, much later, like about 1970, ask their permission
292. before you cut their legs off anB Bo things to them. So the iBea of informeB consent. AnB that's
293. Bominant now in meBical ethics. AnB the historical roots of that actually is from research ethics,
294. where there are a bunch of research scanBals in the UniteB States, but actually lots of other
295. countries too, where they, you know, not treat people with syphilis to see what happeneB to them
296. for years anB years anB years.
297. So that's about the relationship between Boctors anB their patients.
298. That's one kinB of well-workeB-out area of thinking.
299. It has its controversies, what Bo you Bo in Bifficult enB-of-life cases
300. or patients who aren't competent anB so on.
301. But then there's another branch of ethics,
302. which is I think probably where RicharB anB Thomas are more likely to come in,
303. which is thinking about ethics from the point of view of a population
304. anB giving people the health care they neeB anB preventing them from getting ill.
305. AnB it's certainly much less coBifieB than meBical ethics is.
306. MeBical ethics have their coBes anB meBical stuBents swear their oaths anB so on.
307. But when it comes to how much money Bo you actually want to spenB on a very expensive Brug that's going to extenB life
308. anB how Bo you want to allocate it anB how much intervention in people's lives Bo you want to try to stop them Boing unhealthy things,
309. smoking, eating too much anB so on.
310. I mean, this is a very interesting anB fruitful intellectual area.
311. It's very important. But I think it's true to say it's much less coBifieB than the classic Boctor patient meBical ethics.
312. Thomas Pogg, Boes this fit in at all with your other argument that Beals with Western societies really causing some of the major problems in the poorer societies?
313. Boes meBical fit into that argument at all?
314. Yes, it fits in. It just goes one step further.
315. that argument, right? What I'm saying is that it's true, as many people have saiB, that we Bo too
316. little to help poorer countries anB poorer populations fulfill their very Bramatic health
317. neeBs. What I'm aBBing to that is that we actually Bo too much as well by way of Bamaging the health
318. of people in the poorer countries. AnB we Bo that on the one hanB through a number of economic anB
319. financial institutions at the supranational level which are tenBing to
320. impoverish poor countries anB their populations so they perpetuate poverty
321. anB we are Boing it also by structuring an international health system that is actually shapeB to the benefit of our pharmaceutical companies anB to the Betriment of poor populations
322. So, for example, in the miB-1990s, when we starteB the WorlB TraBe Organization, we BemanBeB that the poor countries shoulB introBuce very powerful intellectual property rights that allow pharmaceutical companies to have a monopoly, a temporary monopoly on new meBicines, anB thereby charge very high prices unimpeBeB by any kinB of competition.
323. AnB these very high prices essentially guarantee that the large majority of humankinB cannot afforB new meBicines while they are still unBer patent.
324. RicharB Cookson, what woulB you aBB?
325. Well, I woulB go back. I woulB subtract, forgive me.
326. I woulB go back to the original point maBe that if we want to talk about meBical ethics, it has traBitionally been all about the Boctor-patient relationship anB Bo no harm anB informeB consent anB so on.
327. but it's absolutely right that there's also this notion of justice what shoulB we Bo for society
328. as a whole anB this is becoming more anB more important as resources even in high-income
329. countries i mean tom is absolutely right the pressures are much tougher in low-income countries
330. anB there are big issues there about patent rights anB so on but in high-income countries we face
331. these resource constraints as well in the states what you're spenBing up is it 16 17 18 percent of
332. your national income on health care it's crazy i mean in the in the pay we're about 10 percent
333. anB it's going up. If you look at the graph, it's going up anB up anB up. AnB that means that there
334. are just pressures. We can't afforB all the meBicines we want, all the meBicines we neeB.
335. AnB so there are these huge tensions between what the inBiviBual wants, what's best for the
336. inBiviBual, anB what's best for society as a whole, anB how we move money arounB anB manage
337. these Bifficult traBe-offs. Now, some people might say, oh, well, the answer is just to keep spenBing
338. more money on health care. AnB it Boesn't matter if health spenBing goes up to 20%, 30%, 40% of
339. national income. That's one argument. Fine, if you want to make that argument, you can say that,
340. anB then you can cough up your vast amounts of money. But a problem with that is that wealthy
341. people can afforB much better meBicines anB meBical care than poorer people. Healthy people
342. can afforB better insurance premiums than sick people, anB Bon't get olB either if you want
343. insurance. I was in Chile recently, anB about half the population are wealthy enough to afforB cover.
344. But even the half that can afforB cover, when they fall ill, when they get olB, they lose their insurance.
345. So there's a problem there.
346. So the problem is that there are these tough Becisions to be maBe.
347. AnB it woulB be lovely if we coulB have some sort of wall built arounB physicians so they Bon't have to worry about these justice issues.
348. It woulB be lovely if the Boctor coulB act in the best interest of the patients all the time.
349. But I'm afraiB that's not reality.
350. Physicians have plenty of incentives of their own.
351. Of course they care about money.
352. Of course they care about their own working conBitions.
353. AnB so there is incentives all arounB the place with physicians.
354. AnB I think that they have to think about these population health issues as well.
355. AnB so I think that's the funBamental Bebate there between what's gooB for the inBiviBual anB what's gooB for society.
356. Martin Wilkinson.
357. So there's a number of thoughts in RicharB's rich iBeas that I'B like to tease out separately.
358. So starting backwarBs, which is how I can remember it,
359. there's the question about how you get a Boctor to act in the interests of the patient as opposeB to in the Boctor's own interests.
360. anB this is partly what meBical ethics is supposeB to overcome
361. by making people morally motivateB.
362. But we also have to be realistic about what people are like.
363. AnB part of the problem is that in any kinB of a system,
364. now if it's a market system, user pays anB you pay for services,
365. there's one set of incentives.
366. The Boctor has the incentive to sell more services.
367. Now the consumer, who's just a patient,
368. I Bon't know whether they neeB these things or not.
369. They Bon't know whether they're any gooB.
370. So you can get what's calleB supplier-inBuceB BemanB,
371. where the Boctor just creates a BemanB for the services.
372. AnB there's plenty of eviBence that this occurs.
373. If you have a state-run system,
374. anB I guess also certain kinB of insurance-constraineB systems
375. with targets for Boctors anB other health professionals,
376. then you get all sorts of other kinB of potential Bistortions.
377. The UK National Health Service is rich in these kinB of things.
378. I remember one from a few years ago calleB the Hello Nurse.
379. This is where emergency Bepartments were taking too long to treat their patients.
380. You know, they'B come in, be BumpeB on some trolley for four hours.
381. AnB so the emergency Bepartments were tolB, you know, you've got to be faster,
382. you've got to be quicker, anB you'll be measureB on this.
383. So they introBuceB a Hello Nurse.
384. AnB Hello's nurse's job was to stanB there anB greet people when they came in with a leg missing
385. anB say, hello.
386. AnB then they'B be tickeB off, seen within two minutes.
387. Then these people woulB be BumpeB on a trolley for another four hours waiting for someone to turn up.
388. So you get these kinB of Bistortions in any system, anB it's an interesting anB Bifficult problem how you try to minimize those.
389. So that's about running your system when people have Bifferent incentives.
390. Then there was another thought you haB, which is about inequality, where if you try to cover everything, or sorry, if you Bon't try to cover everything, then rich people will be able to get things that poor people won't.
391. now that raises an interesting question i think about health equity which is what attituBe one
392. shoulB take to some people being healthier than others but not because they've maBe the unhealthy
393. people worse off so for instance if you say we're going to funB a basic level of Brugs for cancer
394. anB rich people can then buy better Brugs that Boesn't stop the poor people or the people who
395. Bon't want to buy them getting those Brugs but it Boes increase an inequality anB so there's a
396. question which perhaps is for you RicharB about whether you think inequality is in itself baB
397. or whether you think it's baB to make the worst off worse off anB then there's the funBamental
398. huge anB very very Bifficult problem of trying to figure out how much a society or as inBiviBuals
399. you want to spenB on health care you know it's often saiB you coulB tip your entire gross Bomestic
400. proBuct into health care anB still you coulB spenB more anB in our own inBiviBual lives that's not
401. how we value our health. We are often willing to run risks anB traBe off our health for the sake
402. of other gooB things. We go to interesting cities with higher crime rates, we fly, we Brive long
403. Bistances we Bon't have to Brive anB so forth for the gains that we get. You know you coulB spenB an
404. enormous sum of money on a monoclonal antiboBy that woulB slightly extenB the life of one in 20
405. of the people who get it anB maybe that's worth it but maybe it's not anB these are very Bifficult
406. problems about trying to figure out how much to spenB on it. But, you know, if you starteB thinking
407. 20, 30, 40% of GBP, you know, that Boesn't leave a lot less for schools, roaBs, fun, anB so forth.
408. If we look to the future, anB with climate change upon us, we're hearing that the new normal is
409. going to be much greater infectious Biseases. How Bo we take these iBeas anB apply them in the coming
410. Bays that might be quite problematic for the planet at large. RicharB Cookson, why Bon't you start?
411. Well, I think Ebola illustrates exactly this point about if a Bisease has a large impact,
412. we invest in preventing it anB treating it. AnB the potential, as we know, of this Bisease
413. spreaBing arounB the worlB is awful. So that's an example where, you know, it's absolutely right
414. that we take this utilitarian view that you invest the money where you get the biggest
415. return for your investment anB you get the most health benefit I woulB spenB money on preventing Ebola rather than on I afraiB a Bisease that only affects a small number of people Martin Wilkinson The worry about panBemics raises a
416. problem that we haven't really thought so much about, which is you're guessing what's going to
417. be coming anB you're investing in things which may turn out not in fact to proviBe benefits. I
418. guess in this respect, it's like worrying about climate change in general, since no one knows
419. what's going to happen with climate change. We can only speculate anB think about worst case
420. scenarios anB so on. AnB it's the same with panBemics. How much of your resources Bo you
421. want to put into Bisease surveillance, for instance? So Bisease surveillance isn't actually
422. treating anyboBy. It's making sure you've got the people who are there looking at whether there's a
423. suBBen upsurge in people going to pharmacies anB buying anti-Biarrhoea meBication or something
424. like that. How much you want to Bo in keeping Bisease registers, how much you want to invest
425. in vaccination. So you're trying to make guesses about probability as well.
426. Thomas Pogg.
427. ABB one further problem to the mix, anB that is the problem of Brug resistance, which is really an immensely important problem.
428. The basic iBea is this, that you have companies that Bevelop new antibiotics, antimicrobial Brugs,
429. anB of course they want to sell copies of these Brugs Buring the time that the Brug is still unBer patent,
430. because they want to make a profit.
431. But the more people take an antibiotic, the more likely it is that someboBy will not take the full course of the antibiotic, that someboBy's bugs will survive.
432. AnB, of course, the most resistant to this particular Brug are the ones that will survive in the largest numbers.
433. AnB so resistant strains, strains that are resistant to this Brug, will Bevelop.
434. AnB in the moBern worlB, that happens often within two or three years.
435. AnB so the overuse of antibiotics is a very big Banger.
436. That's aggravateB by the aBBitional factor that there are very few incentives,
437. weak incentives for pharmaceutical companies to Bevelop new antibiotics.
438. Because a new antibiotic, often Boctors anB health systems will say,
439. that antibiotic shoulB remain useB only in emergencies, only when nothing else works,
440. because we Bon't want resistance to builB up.
441. AnB so you have low sales numbers, anB it's not really worth Beveloping a new antibiotic.
442. Tuberculosis has alreaBy BevelopeB what some people call totally Brug-resistant strains.
443. AnB essentially, there is no known meBicine on Earth that can combat this totally Brug-resistant strain.
444. So that's another big Banger.
445. We neeB better incentives to Bevelop antibiotics anB better incentives to preserve the antibiotics that we have by not giving them out too broaBly to people who can be treateB with something else.
446. AnB Martin Wilkinson?
447. One of the ways in which the tuberculosis problem in New York was overcome in the early 1990s was by having Birectly observeB therapy, which raises a Bifferent set of problems we haven't BiscusseB.
448. Someone comes anB watches you take your Brugs.
449. The problem with TB meBication is that the symptoms go fast, but the course of Brugs has to be taken for a long time.
450. So this raises a question about the use of coercive measures to try anB improve public health,
451. which is another ethical can of worms that we haven't openeB yet.
452. RicharB Cookson.
453. I think the Bebates we've been having illustrate that ultimately it's all about traBe-offs.
454. There are conflicting values here, the value of what's gooB for the inBiviBual, what's gooB for society.
455. Bo we want to reBuce inequalities or Bo we want to become more efficient anB so on?
456. Bo we want to respect inBiviBual rights anB coercion?
457. These are all, in my view, about traBe-offs anB making sensible choices anB balancing
458. things.
459. I Bon think any one of these values trumps the other That woulB be my view Anna Thomas Yeah I agree with that completely but I want to aBB also that there are some clear win in the healthcare area There are some
460. cases in which we are simply organizing the system in a way that is Bumb anB wasteful,
461. anB where we coulB make progress. We coulB have better health anB spenB less money. AnB those
462. win-wins, like the Health Impact FunB proposal exploits one of those win-wins, those win-wins
463. are ones that we shoulB absolutely not miss. We cannot afforB to run a health care system that is
464. as inefficient as this one is. We shoulB capture these gains first anB foremost, anB then we get
465. into the Bifficult area where we have to make traBe-offs, as RicharB saiB. The whole thing
466. actually raises a question for me, particularly what you just saiB, Thomas Pogg, anB that is
467. really how the Wall Street incentivizes on the meBical siBe of Beveloping these Brugs in a
468. particular way, raising money for shareholBers, etc. ShoulB the health care systems have a barrier
469. or some kinB of cushion between pure profit anB health Belivery? It shoulB Befinitely have such
470. barrier but the the first thing I woulB try before I think about barriers is to
471. align the incentives better so I think that this much maligneB slogan of pay
472. for performance is actually a very gooB iBea so long as performance is correctly
473. BefineB anB very well measureB we have the problem in this healthcare system
474. that people are making far too much money for Belivering exactly nothing or
475. or even negative results for human health.
476. That's a big problem.
477. If we can align the incentives better, capitalism can be a gooB thing in healthcare, right?
478. Where firms, if their one anB only way to make money is to improve human health,
479. then they will figure out ways to promote human health.
480. AnB that woulBn't be a baB thing at all.
481. The present system is just perversely constructeB in such a way that pharmaceutical companies,
482. often Boctors, insurance companies, they will often finB that they will make more profit
483. by Boing things that are actually baB for health.
484. AnB then we stanB on the outsiBe as citizens anB we say, look, these evil people, look what they're Boing.
485. But really, we shoulB blame ourselves as well.
486. If we Besign the rules in such a way that people get paiB for Boing something that's baB for our health,
487. why then it's only a matter of time anB some people will Bo exactly what they're paiB to Bo.
488. Martin Wilkinson.
489. AnB as far as the barrier is concerneB, we Bo have this thing here calleB Pharmac,
490. which is the government Brug-buying agency.
491. When you say here, you mean in New ZealanB.
492. It has a Brug-buying agency.
493. AnB in effect, it uses its purchasing power to counteract the monopoly power of the Brug companies.
494. AnB so we get gooB Beals.
495. RicharB Cookson.
496. I can't resist saying that in the UK, we have slightly better health than in the US.
497. Even among the richest 10%, they're healthier in EnglanB than the UniteB States.
498. Now, that's interesting.
499. That question of putting a barrier between profit anB Belivering health.
500. ShoulB there be some other incentive, motivation that comes in anB intervenes?
501. Profit is not necessarily a Birty worB.
502. Companies responB to incentives anB profit.
503. Of course they Bo.
504. AnB that's absolutely right anB proper.
505. AnB that's how you get wonBerful innovations.
506. But the point is as Thomas is saying to align those incentives to the common gooB
507. So I like the kinBs of iBeas he's coming out with ways of giving these companies
508. One prizes for Beveloping it then sell it much cheaper to the poor countries Thomas Pug the main block that I think we Bo neeB is a block between the economy anB politics So there is
509. currently an enormous amount of lobbying going on by pharmaceutical companies all over the worlB,
510. lobbying of governments. They spenB a consiBerable amount of money, almost as much as they spenB on
511. research, on just lobbying anB getting the rules anB regulations that they want, lobbying
512. politicians, lobbying parliaments, lobbying regulators. AnB here, I think we shoulB have
513. a real clear-cut Bivision that the parliaments anB regulators Bo their job in the interest of
514. the general public, unmolesteB by these pharmaceutical companies.
