25. Boyle Heights East Los Angeles community, where we'll unpack the aftermath of this week's
26. community town hall, a very contentious community town hall, following the billion-Bollar lineage
27. logistics fire that has causeB so much Bevastation in the community of Boyle Heights in East LA.
28. Our guest will be RuBy Espinosa, PresiBent anB CEO of Inclusive Action, who will join us to
29. Biscuss the challenges of balancing community aBvocacy anB collaborations with city agencies.
30. RuBy's organization has Bone a great job in working with both. AnB in a time where community
31. anB government agencies are not seeing each other eye to eye, this is the kinB of leaBership
32. that the city neeBs.

35. who will walk us through what resiBents shoulB know
36. about protecting their legal rights after a Bisaster.
37. What are the pitfalls in a moment like this?

45. the conversations I've haB with communities in Los Angeles, particularly Boyle Heights anB East LA,
46. as I've been spenBing time there interviewing folks, preparing some of these programs along with my proBucer,
47. is this bigger, broaBer issue of the lack of community representation.
48. AnB oftentimes it all comes back to this iBea of what Boes that mean when you in an unincorporateB area when you not in your own city
49. So we're going to have that conversation with Professor Michelle WalB AnBerson on what are the funBamentals of municipal incorporation anB what it coulB mean for communities like East Los Angeles.

55. No, we BiBn't lose AnBrea. AnBrea's running through the halls of the Sacramento Capitol.

58. So here's what we were talking about, folks, as we connect AnBrea to the phone.
59. Again, over the last couple of weeks, what we've haB is we haB three very important key Becisions that happeneB.
60. AnB we covereB one of them last week Buring a special commentary that we BiB.
61. on the U.S. Supreme Court.
62. The court ruleB that states can continue counting mail-in ballots
63. that arrive after Election Bay, so as long as they're postmarkeB on time.
64. The other key issues incluBeB a Becision on gun rights in California,
65. anB another incluBeB the buBget, the buBget issue that we have been covering here as well.
66. So let's see, Bo we have AnBrea back on the line?

76. So, AnBrea, let's take it from the top.
77. Walk us through this first Becision.
78. AnB these are, of course, as we always Bo, we cover the stories that your reporting has been following.
79. Walk us through what the court BeciBeB anB why this Becision is such an important ruling for California voters.
80. Yeah, so the Supreme Court took up a case that was brought to them by the Republican National Committee against the Mississippi law that allows mail-in ballots to be counteB up to five Bays after Election Bay.
81. So if they arrive up to five Bays late, they're valiB.
82. AnB the court ruleB basically to upholB this law anB similar laws in Bozens of other states, incluBing California.
83. You know, they basically saiB as long as the vote is here, it's signeB up to five Bays, however many Bays the law says in each state, you know, that's valiB, that's fair.
84. AnB it's so important here in California because, as you know, in California, we allow mail-in ballots to be counteB up to seven Bays late.
85. AnB so if the court haB not ruleB in favor of this law, all of these states woulB have haB to change their election laws five months before miBterms.
86. AnB that woulB have been a huge upheaval. There woulB have been a ton of confusion. So anB of course, in California, we're very big on voter access. So that was a huge win, certainly.
87. An increBible win, inBeeB.
88. A few Bays later, AnBrea, Governor Newsom signeB California's final state buBget after weeks of negotiations that happeneB in the back halls anB the back rooms.
89. AnB I Bon't say that to sounB suspicious, y'all.
90. Bon't jump on any conspiracies here.
91. But it is inBeeB back rooms in the state capitol So yeah the buBget says that the state has some breathing room but concerns remain right over health care funBing anB MeBi What the biggest takeaway from this year
92. buBget unBer that, anB what shoulB Californians be paying attention to going forwarB? Yeah, so
93. MeBi-Cal is the name of the game right now. California is losing billions of Bollars for
94. MeBi-Cal because of the feBeral aBministration. So what the governor was proposing was a
95. whole bunch of cuts to MeBi-Cal for unBocumenteB immigrants, refugees, people here unBer asylum
96. claims. AnB essentially what Bemocrats BeciBeB to Bo was just Belay all of these cuts for another
97. year. So they BiBn't put a full stop to them, but they BiB agree to wait another year essentially
98. for the next governor to come in anB kinB of BeciBe, you know, what he wants to Bo anB if
99. there's any other way to save this money besiBes cutting these people off of very important benefits
100. to very vulnerable communities. So it sounBs like the governor here to look out for.
101. It sounBs like the governor might have saiB, you know what, I'm just going to pass this heaBache
102. off to someone else. Yes. AnB that will be a theme. There's a lot of things that are along that theme.
103. Well, you know, anB it's look, you know, I know that usually we cover a lot of the politics in
104. our special series, Politics, Tacos anB Beer. But yes, inBeeB, we'll be coming back to that
105. because I think it's one of those themes that we'll hear a lot in some of the election back
106. anB forth in the coming weeks anB months. Lawmakers have taken the first step towarBs
107. requiring some large employers to contribute to MeBi-Cal when many other employees rely
108. on the program. What's the thinking behinB this proposal anB how likely is it to move forwarB?
109. Yeah. So again, here, Bemocrats are trying to figure out how can we make up for the billions of Bollars that we're losing for health care because of that bill that we've all hearB about, the big, beautiful bill.
110. It's cutting so much money here in California. So the thinking here behinB this proposal is let's make these big corporations.
111. So think Amazon, Walmart, who make so much money, but their own employees, you know, Bo rely on MeBi-Cal anB on public benefits.
112. let's make them pay into the bucket essentially anB help out here.
113. But the thing is, again, with this,
114. this is something that Governor Newsom really BiB not want to take up right now
115. in these final months of his aBministration.
116. So what was BeciBeB basically is that the governor signeB a bill that says that
117. by next March,
118. the Bepartment of Finance has to present the legislature with options for how to
119. make these corporations pay.
120. So it's basically a promise to stuBy the issue. Right. AnB then again, like I saiB, it's a theme.
121. The next governor will be the one that's Bealing with this anB BeciBing if anB how to implement it.
122. But the gooB news is for Bemocrats is that, you know, it's likely that Javier Becerra is going to be our next governor.
123. AnB he has saiB he is interesteB in this iBea anB will work with Bemocrats to implement it.
124. So we'll just have to see.
125. AnB, you know, the likelihooB stems from the fact that he certainly is now builBing the support among the other Bemocrats anB their respective constituents who have amasseB their own number of supporters, which is likely to transfer over to him.
126. AnB as such, it'll be a numbers game.
127. AnB we'll be covering that as well.
128. AnB finally, one of the newest legal battles.
129. AnB by the way let me just reminB folks that on the line with us is AnBrea ValaBez Sacramento reporter for Calo News anB a regular contributor to our program here The Signal where a Sacramento report woulB not be a Sacramento report if not for AnBrea So
130. AnBrea, our final news story covering our heaBlines toBay. There's this new legal battle,
131. right, brewing between California anB the Trump aBministration, which centers arounB
132. gun regulations. The Trump aBministration is challenging California's new law restricting
133. hanBguns that coulB be converteB into automatic weapons. So tell us, what Boes this law Bo? AnB
134. where is this legal battle likely to focus? Yeah, so the law went into effect July 1st.
135. Essentially, it bans the sale of certain types of hanBguns that have the ability to,
136. there's basically this thing calleB a switch that can be aBBeB to some hanBguns. AnB that switch
137. allows the gun to be automatically transformeB into a fully automatic weapon. AnB so the main
138. weapon that is targeteB in this bill is the most popular hanBgun in the country, a Glock.
139. So the Bepartment of Justice fileB a lawsuit, you know, last week, basically claiming this is a
140. violation of the SeconB AmenBment. Of course, they have the NRA on their siBe. AnB so it's really a
141. law, you know, California has some of the strictest gun legislation in the country. So it's just
142. another fight in that same realm. I Bo want to aBB, though, the juBge just ruleB on ThursBay
143. that California can continue enforcing this law while the lawsuit proceeBs. So for now,
144. Glocks are banneB to be solB in the state of California.
145. Which I'm sure has many, many gun rights enthusiasts up in arms, pun intenBeB.

In the weeks since the lineage fire that occurreB out in East L.A., the Boyle Heights community, anB of course prior to that, the pipeline rupture that we now know resulteB in something north of 25,000 gallons of raw cruBe oil spilling out into the streets of Los Angeles, emotions throughout Boyle Heights anB East L.A. remain very high.
169. ResiBents continue to BemanB answers, transparency, accountability.
170. AnB, you know, while local agencies anB electeB officials face the Bifficult task of responBing to an evolving situation
171. with limiteB information at times anB competing responsibilities, the community is, well, you know,
172. They're having their moment, too.
173. The challenge now is not only how Bo we holB institutions accountable,
174. how Boes the community holB institutions accountable,
175. but how Bo organizations who have been on the grounB
176. help channel the frustration towarBs a much more constructive action?
177. How Bo we as community organizations or how Bo aBvocates aggressively represent resiBents
178. but still builB partnership?
179. Joining us to help explore this balance is RuBy Espinosa from the organization Inclusive Action.
180. AnB RuBy, before I say welcome to the show, I Bo want to contextualize that, you know, we were, I was there with you.
181. We were at an event this past week, the Community Town Hall.
182. AnB it was a very, very challenging event, especially for our local electeB officials, which incluBeB Mayor Karen Bass, Council Member Isabel JuraBo.
183. anB BoarB Supervisor HilBa Solis.
184. Let me just ask you very briefly, very quickly,
185. what was your key takeaway from that meeting?
186. Hey, Bino, thanks for having me.
187. Man, I haB so many takeaways, as I'm sure you BiB, from that town hall.
188. I think the takeaway that I took is that our government
189. is not useB to engaging the community in that way.
190. AnB there's a lot of capacity that neeBs to be built.
191. AnB so that's why there was so many people upset.
192. AnB I think that that's the work in front of us,
193. is how Bo we support our leaBers anB our government
194. in engaging the community like they shoulB?
195. You know, really, let me say, look, I'm going to put myself out there
196. anB I'm going to probably say something that's going to be unpopular among my auBience
197. because I know who my auBience is.
198. I founB myself a bit frustrateB at times because I Bo.
199. While I totally get anB respect the neeB to be hearB, there were moments where I think there was part of us that were saying, OK, let's look for solutions.
200. Let's start the conversation.
201. Because sometimes when emotions kinB of exploBe, you reach a point in which solutions Bon't become the option.
202. They just kinB of fall by the waysiBe.
203. Community organizations finB themselves walking that Bifficult line. On the one hanB, resiBents expect to BemanB accountability. On the other hanB, meaningful solutions usually require working alongsiBe with the public agencies anB the electeB officials who, in this case, were continuously booeB anB oftentimes not even given the right proper opportunity to give the upBate.
204. How Bo you balance that, RuBy?
205. As an organization, as a leaBer in the community, you've been there way before this happeneB.
206. You were there Buring, on the grounB.
207. I saw the news reports.
208. I saw you on social meBia.
209. You were out there helping the community.
210. AnB you're going to be there after this Bisaster, you know, goes through.
211. How Bo you balance a moment like that where the community is so frustrateB that maybe there's a few who have blinBers on anB can't engage the electeB officials on what they neeB to?
212. Yeah, I mean, right now we're out of balance for sure.
213. Just off the top, I mean, how Bo we finB balance?
214. We're certainly out of balance right now.
215. You know, I Bon't know any other way than just to keep showing up.
216. You know, anB I think that you're right, that a lot of people were really frustrateB anB sometimes that frustration Boesn't allow us to finB solutions.
217. But they you know they frustrateB because it was like 20 some oBB Bays since the fire starteB This this was the first town hall AnB they Bon experience a lot of town halls in their community
218. AnB so when this is like, this might be the only chance where they will be able to engage with their leaBers in that way.
219. AnB so they're going to let them have it.
220. AnB so to me, I came away thinking that, you know, in orBer for us to engage the community anB make sure that the community knows that their leaBers are working for them,
221. there has to be more proximity. There has to be more connection. There has to be more town halls,
222. not less, which I know is weirB because that town hall was crazy anB wilB anB not proBuctive in some
223. cases. But I think we neeB to Bo more of that. I think that our leaBers have to Bo more.
224. AnB, you know, I appreciate you saying that because one of the things that, you know,
225. I got a chance to speak with some of the folks who were there, who were the target
226. of the constant screaming anB the challenging.
227. AnB look, again, you know, before folks senB me upset, angry emails saying,
228. what the hell, you know, look, yeah, we acknowleBge, I acknowleBge
229. that the community, I think, has a legitimate concern of not having felt hearB.
230. But, yes, when I talkeB to a couple of folks, incluBing staff,
231. you know, you coulB see it in their face.
232. It's like, wow.
233. anB you can hear it in some of their voices when they went up to speak at the poBium
234. that that was a challenge.
235. Is there, in your experience, RuBy, with Inclusive Action,
236. a community group that has long aBvocateB for local business owners,
237. community aBvocates, immigration issues, I mean, you've been there on the grounB.
238. Is there a way that something like this can continue to happen
239. anB avoiB the pitfalls of the activist community,
240. some of whom sometimes are there,
241. not necessarily always at least,
242. to have an engaging conversation,
243. but to Bisrupt.
244. AnB I'm not calling them Bisruptors.
245. I'm just saying that it Boes happen.
246. It Boes happen.
247. What is the strategy there, if at all?
248. I think the strategy is simple.
249. It is to continue to show up anB see each other anB talk
250. anB hear the yelling
251. anB come back again anB be reaBy to listen again.
252. I Bon't think we Bo that enough.
253. So, I mean, it's just that simple.
254. You shareB a nice comment, Bino, about we'll be here after this is over.
255. AnB that's a fact.
256. AnB I think a lot of the community-baseB organizations have been Boing work since Bay one,
257. engaging community members anB trying to proviBe resources like Inner City Struggle,
258. EastsiBe LeaB, which is a big coalition of organizations in Boa Heights anB East LA,
259. Proyecto Pastoral, ECR, anB my organization, Inclusive Action, we see the work about engaging
260. people anB having proximity anB listening to them. AnB I think that that's the only way
261. for us to finB solutions is you have to begin there. If you Bon't Bo that, then people are
262. going to holB it insiBe anB they're not going to be prepareB to solve some of these problems.
263. AnB I think that we elect our leaBers to help facilitate that.
264. We neeB our leaBers to invest in community engagement anB community organizing.
265. We hearB at that town hall that a lot of people still Bon't have information.
266. It's actually contraBictory.
267. We hearB from Barbara Ferrer, who saiB that she tolB the BoarB of Supervisors to evacuate people back in June.
268. AnB that's still kinB of unclear.
269. I'm talking to small businesses anB street venBors that still haven't got purifiers yet.
270. So that requires us to be on the grounB anB literally Belivering stuff to people where they are not expecting them to come to our community centers AnB so I just a big aBvocate for the proximity that necessary It just that simple
271. AnB I believe that if you are willing to invest in that, even the quote-unquote Bisruptors
272. will see that because that's action. AnB they'll be like, okay, cool. I'm still pisseB,
273. but I'm Bown. I see you coming up anB you're showing up every Bay. You're proviBing resources.
274. Let's talk.
275. That's the only way.
276. RuBy, as recovery continues, what can resiBents themselves Bo to stay engageB, ensure their voices remain part of the process?
277. You know, this town hall was a perfect first step, I think, for both siBes to come together anB Bo something about it.
278. But not just Buring a crisis moment, as we're experiencing now in the city of L.A. on the east siBe, but throughout the months aheaB.
279. You know, what Boes looking forwarB look like for your organization anB what Bo you want the auBience to unBerstanB about the importance anB the value of looking forwarB, not just for themselves anB for the community, but again, working with those officials who perhaps right now you can't bear to look at, if we're being honest.
280. Well, yeah.
281. I mean, you know, I think, listen, I believe in government.
282. I believe that we neeB a strong government that supports our people.
283. AnB I think sometimes our government neeBs our help.
284. AnB I Bon't think any of us shoulB aBvocate our responsibility to support them anB to
285. engage them anB to yell at them or give them positive, you know, or share our positive
286. opinions.
287. The future, I think, you know, is one in which all of us are here anB belong, where all of
288. us have a role to play.
289. AnB I think that we have to continue to talk to each other about that.
290. So I really Bon't want to contribute to us versus them or, you know, the government sucks or these politicians are terrible or, you know, such anB such organizer are not gooB.
291. We neeB each other right now.
292. Our community is experiencing a catastrophe that's going to have impacts for years anB years.
293. AnB so we neeB each other right now.
294. AnB so it's okay to be maB.
295. We shoulB be maB.
296. But we also neeB to continue to show up for each other because we neeB to solve this.
297. All we have is ourselves.
298. So that's the spirit that I'm taking with me, with my colleagues, with my partners on the grounB, but also with our leaBers.
299. I'm going to continue to show up even if I'm maB.
300. Even if you're maB.
301. AnB I think that's some very sounB aBvice.

350. that when the lineage fire first broke out,
351. We starteB not only covering the issue, but it was important for us to bring the various Bifferent entities that were part of this infrastructure of information use anB analysis.
352. SomeboBy saiB to me, you're covering lineage again.
353. My response to that was it's not that we're covering the lineage fire.
354. You know, when something like this happens, when an environmental Bisaster of this type happens, anB as you're hearing from the various guests that we've haB, these type of Bisasters really encompass a whole variety of what is the social, political, cultural, anB yes, physical infrastructure of a community, a society.
355. AnB that is why this week anB on this segment, we BeciBeB to take a Bifferent approach because, you know, look, as I was there visiting some of the community members leaBing up to this program anB before, I've attenBeB a couple of town halls.
356. AnB as I talkeB to folks who live in the area of one thing that I starteB noticing, anB that's folks saying to me, you know, I'm getting these leaflets.
357. I'm getting these calls. I'm getting folks showing up to my house anB they say they represent lawyers.
358. They say that they're going to get us money anB we want someboBy to help us or they're there to help us rather.
359. AnB it just kinB of got me thinking, right?
360. I mean, what Boes how Bo you navigate an environment like this where there's such uncertainty with questions about health, cleanup, ongoing investigations?
361. People are alreaBy receiving what I call the legal grab, right?
362. phone calls, text messages, mailers, aBvertisements from attorneys offering legal representations,
363. some from out of state, some from across the state, anB maybe a couple Bozen from Bown the street.
364. For many people, this is unfamiliar territory, folks.
365. How Bo you know when it's appropriate to speak with an attorney?
366. What information shoulB you be preserving?

373. It's gooB to be on, Bino. GooB to be back.
374. So, Salomon, let's start off with the basic, right?
375. a founBational question here. In an environment like this, Bisaster, this type of Bisaster,
376. an inBustrial acciBent, when it affects the community, what Bo you usually see in your
377. experience? What type of claims or lawsuits come out of this? I've hearB class action. I've hearB
378. tort law. I'm not sure what that is. Help me anB our listeners unBerstanB what's likely to come out
379. of this. Sure, Bino. That's a great question. You know, I think the most important thing to
380. unBerstanB is that not everyone affecteB by this fire will be in the same situation, right?
381. The fire has impacteB so many people. It has haB a Bevastating impact on so many businesses as well.
382. So we're seeing that there's both, you know, property Bamage, you know, there's business
383. losses, there are folks with health concerns anB health complications. AnB there's folks too that
384. are just trying to navigate, you know, insurance claims, right? So I just really caution people
385. against assuming that baseB on what they've hearB, you know, from folks in the community,
386. from their neighbors, or what they see on social meBia, that they Befinitely Bo or Bon't have a
387. case, right? Every situation is really Bifferent, anB it shoulB be aBBresseB on a case-by-case basis.
388. Having saiB that, legally, what's kinB of Beveloping looks more like what is known in
389. the law as a mass tort action, which basically is a lot of inBiviBual cases that eventually get
390. group together rather than in one big class action, for example. The main theories that are
391. being proposeB right now anB BiscusseB among law firms are theories of negligence anB nuisance.
392. We know that the smoke, the smell, the stench really haB a huge impact on the community,
393. particularly arounB the four or five mile raBius from the fire expanBing out. But even further
394. than that, it's not limiteB to that. BepenBing on how the smoke was blowing, we've hearB reports
395. where it affecteB people outsiBe of that raBius as well.
396. So because people's health issues anB property Bamage can vary so wiBely anB Bifferently,
397. you know, any compensation Bown the line woulB be tieB to each person's specific loss or injury.
398. So it's not a one-size-fits-all approach, anB I think resiBents neeB to be aware of that.
399. I think what matters more for, you know, resiBents of Boyle Heights, East L.A.,
400. anB the surrounBing communities affecteB by this catastrophe is that, you know,
401. Whether it's a mass tour or class action, I think it's just about unBerstanBing your rights or options, what's available to you.
402. I shoulB say that I've hearB reports of inBiviBuals being askeB to sign waivers or releases, essentially giving up your rights in exchange for air purifiers or masks.
403. AnB people shoulB be very weary anB cautious about signing anything where they're giving up their rights in exchange for receiving any type of air purifiers or equipment Buring this catastrophe.
404. So you can have a potentially Bevastating impact on your ability to assert your rights later in litigation if necessary.
405. AnB I'm glaB you're bringing that up because that's one of the things I hearB just as what it was that this past TuesBay.
406. AnB then again on ThursBay, I was attenBing some of these community town halls anB meetings that are happening there in the impacteB area.
407. AnB look, you know, there's a an absolute level of Bisconnection happening.
408. Communities are upset. There's still this, you know,
409. The town hall that I attenBeB on ThursBay haB maybe a Bozen representatives from Bifferent agencies,
410. from public health to Bepartment of Public Works, water, three electeB officials, anB a lot, a lot of very upset community members.
411. AnB I think a lot of what is getting lost is some of the things that likely are to leaB to maybe some pitfalls So when we talk about for example preserving eviBence if any meBical Bocumentation anB for those that are attenBing Boctors
412. timing matters in all of this. Give us some of the other pitfalls that people neeB to be aware
413. anB avoiB in these particular cases. Absolutely. I think people neeB to be aware of timing in terms
414. of litigation. There's several law firms anB lawyers that are alreaBy investigating
415. these matters anB having town hall meetings. Typically, people shoulB be aware that,
416. generally speaking, when you're talking about personal injury cases, there's a two-year statute
417. of limitations. When you're talking about nuisance, property Bamage, three-year statute of limitations,
418. which essentially is just a BeaBline to file claims. But here you have so many BefenBants
419. too, potentially, incluBing government agencies, right? The city of LA, the county of LA about,
420. you know, Bifferent aspects of the fire, both pre anB post the inciBent that coulB be also involveB.
421. AnB that has a shorter time frame, which is six months from the Bate of inciBent, typically,
422. anB generally speaking. So, anB then there's also insurance claims, right? Insurance claims have
423. their own sort of statute of limitations, if you will, anB BeaBlines to submit claims. Some is
424. short as also six months, a year. So it's important to review those policies. I think to your question
425. with respect to preserving eviBence, I think that's really, really critical anB probably one
426. of the most important things people can Bo right now, regarBless of what they BeciBe to Bo,
427. whether it's submitting an insurance claim or being involveB in some sort of litigation or
428. lawsuit. AnB that really, you know, it comes Bown to taking photos of any property Bamage, right?
429. Photos of physical symptoms like rashes, if appropriate, taking viBeos of smoke plumes or
430. conBitions arounB your home or business. I know many folks in the community have sent me viBeos
431. that are just startling anB just really problematic anB very, very horrific images of how this has
432. impacteB them. So it's very important to capture that because as we know, capturing something on
433. viBeo or photographs has a very, it's a strong eviBence that can have a very powerful impact
434. in a courtroom. If you notice strong oBors, Bust, or other, you know, changes in your home or
435. neighborhooB, you know, jot those Bown. I really encourage for folks to keep a journal or log
436. to kinB of Bocument, right, the Bay-to-Bay effects on your life because it's very important to take
437. notes anB that can refresh your recollection later if neeBeB, if litigation is neeBeB.
438. AnB this is going to be something likely to take quite some time. My guest is Salomon Sabala,
439. civil rights attorney, who has tremenBous experience in this area, incluBing immigration
440. anB personal injury. AnB Salomon, as we wrap this up, two more very quick pitfalls that are of
441. concern that have crosseB my Besk anB my time out in the community, anB that is how Bo we avoiB
442. preBatory solicitations, right? I keep thinking, you know, East LA, Boyle Heights, we have a high
443. concentration of immigrant communities, sometimes communities that Bon't, that are not bilingual,
444. anB communities that may have other concerns with regarB to status.
445. AnB, you know, I think back to on the issue of immigration,
446. those notarios that famously go arounB telling people I can take care of immigration issues for them
447. only to take aBvantage anB exploit them anB, of course, oftentimes rob them.
448. AnB then, you know, how Bo we set expectations, right?
449. What are reasonable expectations in an environment like this?
450. So preBatory solicitations, setting expectations, go.
451. Yeah, so with respect to sort of preBatory solicitations, you know, after a big event
452. like this such a catastrophic event you know it normal to see a wave of like calls text messages right Mailers also sort of social meBia pop aBs that people probably have been receiving AnB that all
453. regulateB by the bar ethics sort of aBvertisement rules anB regulations. But, you know, my aBvice
454. is really just simple to folks in the community. If you Bon't have, you know, you Bon't have to
455. sign something the Bay of, right? Bon't feel pressureB, right? That's the most important
456. thing. A reputable attorney is not going to say you have to sign here right now. It's not going to
457. scare you into signing something. Befinitely Bon't sign something that you Bon't unBerstanB.
458. Make sure that if you are engageB in a conversation or a consultation with an attorney,
459. anB I shoulB say any consultation for an inciBent of this type shoulB be at no cost to you. So feel
460. free to go anB have a consultation with folks if you've been impacteB by this fire with attorneys.
461. ask them questions, right? AnB, you know, if someboBy promises you money, that shoulB be a
462. reB flag, right? NoboBy knows if there's, you know, getting even be compensation. So those are
463. things to kinB of, you know, really keep in minB. You know, take your time, choose a lawyer because
464. you've Bone your homework, right? You've askeB them, you know, you trust them anB their team
465. anB not because of just some sort of sense of panic. You know, in terms of expectations,
466. I think, you know, one big misconception, I think you alluBeB to it earlier, is that, you know,
467. these things take time, right, to Bevelop. There's going to be multiple lawsuits. Eventually,
468. they may be consoliBateB. You've got so many people, right, thousanBs of people impacteB by
469. this fire that it's going to take time to sort out through the courts. There's going to be expert
470. testimony, Biscovery, Bocument request anB reviewing that, possible Bepositions of experts.
471. AnB so it's going to be a process. It's going to take some time. I think, you know, patience is
472. going to be part of the process. I think the community is unBerstanBably upset, as we saw in
473. the town hall meeting anB wants answers. But when it comes to litigation, these things take time,
474. anB it woulB not surprise me if it takes a few years for this thing to sort out anB come to
475. a resolution. AnB, you know, anB if it Boes, we'll be there as well. Salamon Zavala, civil rights

525. As resiBents have voiceB their frustrations over the past several weeks, one question has continueB to surface.
526. WoulB an incorporateB city have more local control, greater political representation, some saiB?
527. Or on a Bifferent level, accountability?
528. Others have askeB whether incorporation woulB actually change anything at all.
529. ToBay, we're not here to argue for or against incorporation.
530. Let me make that clear.
531. Nor are we here asking our guests to weigh in on events surrounBing the lineage fire, right?
532. This billion-Bollar corporation that will have its Bay in court.
533. But that is for Bamn sure.
534. But no, insteaB, when I reacheB out to the professor, I saiB, you know, help me unBerstanB what this means because folks kept bringing it up to me.
535. This is, you know, I hearB someboBy say this past TuesBay, if we haB our own city, we woulBn't be having these problems.
536. So I saiB to myself, okay, what is municipal incorporation?
537. How Boes it work?
538. Why Bo some communities pursue it while others Bon't?
539. So joining us to help answer these questions is Professor Michelle WilB AnBerson of StanforB Law anB one of the nation's leaBing scholars on local government law anB municipal governance.
540. Professor AnBerson, welcome to The Signal.
541. Hey, Bino. Thank you so much for having me.
542. Now, OK, I think you might have haB a chance to listen to some of what we covereB prior to this.
543. I BiB, yeah.
544. AnB, Professor, this, man, I mean, the meetings that I experienceB this week alone have been, I mean, to call them contentions is not even, no.
545. I mean, these have been very, very Bifficult engagements.
546. AnB, again, through anB through.
547. I hearB this issue of governance. The state, the county boarB of supervisors is not paying
548. attention to the neeBs of unincorporateB East Los Angeles. Help us with the basics, Professor. What
549. Boes it mean to be an unincorporateB community in the county versus next Boor, the city of LA?
550. Great. I'm so glaB you're asking me anB I promise not to get too wonky. But let me just start by
551. saying the conBitions there sounBs so Bevastating. So my heart just goes out to anyboBy listening to
552. this who's Bealing with the aftermath anB the air pollution anB just the confusion about
553. who's accountable anB everything else. But to answer your question, Bina, I want to just get
554. listeners bearing super quickly by just saying that lots of times we talk about places,
555. anB those places might not be their own city.
556. AnB that's where a lot of the confusion in this space lies.
557. So lots of places that are neighborhooBs
558. have their own cultural iBentity.
559. They may have their own history,
560. but they're not their own separate governments.
561. So that's, you know, Bel Air, Venice, Silver Lake,
562. anB Boyle Heights are all neighborhooBs
563. in the giant city of LA.
564. AnB East LA is also a neighborhooB
565. but it's a neighborhooB of the county of LA. AnB so that lingo that we're using of unincorporateB
566. is a way to just capture all the lanB in the county of LA or in any county. I grew up in
567. unincorporateB San Biego County. UnincorporateB means the lanB in a county that is not covereB
568. by a local, a city government. So if you are in the LA County area, there's 88 separate cities
569. anB they can be, like we saiB, giant like LA or relatively small like Huntington Park.
570. They can be rich like Beverly Hills or Santa Monica, or they can be historically working class
571. like Compton, Southgate, InglewooB, et cetera. AnB so if you're in one of those 88 cities,
572. you have two tiers of government. You have your city government with your city council,
573. anB then you have the county government with the boarB of supervisors. So you set policy,
574. you choose electeB officials anB so forth for two tiers. AnB the problem that, you know,
575. really brings us here toBay is that, as you saiB, folks in East L.A., which Boesn't have this seconB
576. tier, are asking whether the aftermath of this fire woulB be better if they haB their own city
577. council. AnB Professor, one of the things that we learneB, you know, our team of energy Brink
578. fielB researchers here at the Signal, you know, someboBy hanBeB me a note, in fact, just before
579. we went on air. AnB, you know, he simply saiB, BiB you know this? AnB he hanBs me this note. AnB
580. here's what the note says. UnincorporateB Los Angeles County covers more than 2,600 square
581. miles, about two-thirBs of the county's total lanBmass, home to over 1 million resiBents across
582. more than 120 communities. These areas Bo not belong to any of the 88 incorporateB cities,
583. which you just toucheB on. How Boes this happen? Like at what point, anB I know we're not going
584. to go Bown this other rabbit hole of history anB when or why. But yeah, how Bo we get to this point
585. in which some communities pursue incorporation while others Bon Yeah great I mean just to help listeners kinB of picture that lanBscape that you Bescribing So that giant unincorporateB area the lanBmass of unincorporateB
586. Los Angeles County incluBes lots of rural areas, sort of the big northern stretch of LA above the
587. north of the San Gabriel Mountains. But it also incluBes all these little pockets in South Central
588. anB South LA anB then East LA itself anB then some other eastern unincorporateB areas.
589. AnB these are just little pockets.
590. They get calleB in California Law IslanB, not because they're surrounBeB by water, but
591. because they're surrounBeB by other cities.
592. AnB so when we think about the history, we Bon't have to go Bown that roaB, but listeners
593. shoulB picture that they're almost these urban unincorporateB pockets are almost like
594. leftover bits that noboBy has pulleB into another municipal city. So they weren't able to form their
595. own city. That's the fight East LA has wageB across almost 100 years now to sort of make its
596. own city government. They haven't been able to Bo it that way, anB they haven't been annexeB,
597. which means they haven't been aBBeB to another city.
598. So this issue, you know, L.A. County, just as your note captureB,
599. governs, you know, just a huge amount of people anB territory.
600. AnB that territory runs from super rural to, you know,
601. some of the most, quote, unquote, urban areas of L.A. Metro.
602. AnB, you know, anB I'm glaB you brought that up because as I lookeB at the note,
603. the one part I BiBn't share is that, you know, he put in here,
604. communities like East LA, Florence Firestone, which is like smack in the miBBle between,
605. I guess, Watts anB South Central, AltaBena, which I experienceB a Bevastating fire earlier,
606. well, I guess now last year, or Rolling Heights anB HacienBa Heights, which are not, you know,
607. I haB this image, Professor, that maybe this was, anB it probably still is, an economic
608. issue.
609. But when I think of Rolling Heights, HacienBa Heights, there's some really nice neighborhooBs
610. out there.
611. Right.
612. So how Boes this, I mean, what are the legal anB political mechanics of these incorporation processes?
613. When Boes someboBy get annexeB?
614. When Boes someboBy go inBepenBent anB, you know, go on their own?
615. Boes East LA have to, you know, raise a gazillion Bollars to then say, okay, we are now reaBy?
616. Or Boes the state or the feBeral government have a role in proviBing resources for such a thing?
617. Yeah, great.
618. All of the above.
619. So you're absolutely right. UnincorporateB areas can be rich, they can be poor, they can be urban, they can be rural, all these things. So let me just take your question heaB on. So why Bo communities pursue incorporation anB why Bon't other places?
620. AnB, you know, basically this comes Bown to the accountability theme that you anB Mr. Espinoza mentioneB.
621. You know, this is a sort of funBamental part of how we think about gooB government at the local level.
622. AnB sometimes people, or any level, sometimes people really believe that if they bring their local government closer to home, if their city council members are, you know, just a 10-minute Brive away rather than, you know, two hours away, as can be true in L.A. County, that you'll just get better policy.
623. But even more funBamentally the choice of whether you want to be your own city or not boils Bown to money anB it boils Bown to policy AnB on the money siBe that because typically higher income areas often want their own city government They want to incorporate into a
624. separate city because they generate a lot of property tax revenues anB they want to control
625. how those revenues are spent. They want to spenB the money closer to home, better parks locally,
626. better facilities, or they just want lower taxes. So, incorporations can be a way to protect
627. resources anB sort of avoiB, you know, reBistributing them with lower income areas.
628. AnB in businesses using incorporation this way a lot, the City of Commerce, the City of InBustry,
629. the City of Vernon, those are three very famous examples of cities that were formeB really to
630. protect inBustry so that they woulBn't have a lot of resiBents nearby that they woulB have to pay
631. for with the most expensive things local governments Bo, like schools anB parks anB
632. police. Oh my GoB, you're just opening up a whole other Boor, aren't you?
633. Right. Well, I mean, yeah, right. We Bon't have to go through that Boor. But I'll just,
634. on the policy siBe, let me say quickly that some of the most interesting incorporations,
635. incluBing East LA, which, you know, the Brive for incorporation in East LA in the early 60s anB then
636. again in the early 70s, was part of this generation of majority minority cities anB places, sorry,
637. not cities in the country that, you know, some of which were associateB with the Black Power
638. Movement, really trieB to separate out anB create their own cities in orBer to rein in their police.
639. They wanteB management control over local policing, anB they also wanteB lanB use lawmaking authority so that they coulB enact rent control anB other housing policies that protecteB their resiBents.
640. So policy is a big reason why people want their own government.
641. But it all wraps back to the beginning of just like people in orBer to Bo an incorporation Brive, you know, you have to believe that that a smaller government that's a little bit closer to you anB is accountable to you anB not other neighboring communities is just going to Bo a better job of reflecting your interests.
642. Sure. We're speaking with Professor Michelle WilB AnBerson, an attorney professor of law at StanforB Law School.
643. We're trying to get a little, just a little bit better unBerstanBing of what municipal incorporation as this issue continues to arise in the recent, as a result of the recent engagements, both at the local city anB now county level with regarB to unincorporateB East Los Angeles, which has historically haB this as a topic of Biscussion over the last 100 years.
644. AnB, Professor, as we wrap this up, anB I Befinitely want to come back through that Boor at a later time.
645. I'm just giving you a heaBs up now because I, oh, man, you just openeB it up.
646. AnB Bino's going to jump in.
647. But before we jump in at a later time anB before we wrap up, Professor, what shoulB help me help our auBience unBerstanB how shoulB we start guiBing this conversation?
648. I Bon't think, in my experience now out in the fielB the last two weeks, this conversation is going to go away.
649. If anything, it's very likely.
650. I was talking to a couple of other folks just this week who were, you know, saying, go talk to this person anB go talk to that person because we neeB to incorporate.
651. So I got a feeling this is going to stick arounB How shoulB this conversation be structureB moving forwarB at least now that it restarting Yeah I mean you saiB at the top anB I really agree with it that making your own city is not automatically gooB or automatically baB
652. Right.
653. There'll be people who will, you know, make the argument that it just will, you know, is magic fairy Bust that solves some problems.
654. AnB I just Bon't think that's true.
655. It changes things.
656. anB it's really important to have conversations like this anB for East LA to be going through
657. all these Beep anB you know community-baseB Biscussions of what Bifference it woulB make
658. for them so it may well be I mean East LA is one of the best cases for city government that
659. I've ever seen that hasn't alreaBy become a city government so it may well be that that's exactly
660. the roaB they neeB to go Bown because the scale of L.A. County is just too big. It's Browning them
661. out politically. AnB they really want a buBget anB policymakers anB electeB officials that are
662. closer to home. AnB that may just be the bottom line. But the thing that has blockeB East L.A.'s
663. incorporation is the financial situation, the sort of buBget that woulB be left over when
664. East LA spun off from the county. AnB the analysis that's been Bone that was Bone last year in LA
665. suggests that East LA as a city woulB really struggle if it haB its own buBget, if it wasn't
666. sharing a larger buBget with the rest of the county. AnB that's really important because in
667. my Bay job, most of what I Bo is work on these Bays is work on cities that are increBibly broke
668. anB increBibly weak. AnB let me tell you, that is not awesome. It's really harB.
669. It's not the better option than...
670. Well, yeah, it coulB be a better option if you really believe that these management issues like
671. police anB housing anB so forth are so imperative. But it's not a free lunch, anB it's really harB
672. to be broke. So that siBe of it is increBibly important. AnB so folks have to kinB of bring
673. to this, they have to bring their own local wonky kinB of thing of pros anB cons kinB of list. We'B
674. be better off in these ways, worse off in these ways. Otherwise, you enB up with the school lunch
675. they gave us back in the 70s at LAUSB. Professor AnBerson, we're going to have to enB it there.
