18. Good morning, everyone out there.
19. We're going to begin our show today with a discussion of the Racial Justice Act.
20. This was something passed in 2020 by Assemblyperson Ash Kalra.
21. And this was a very, very important piece of legislation because up until 2020, people didn't have the ability to channel racial bias.
22. although we know it existed in the courtroom.
23. I mean, racial bias is part of the history of this country.
24. Alexandra, oh, I'm sorry, my guest is Alexandra Cook.
25. She has been a lawyer in Washington State for 44 years.
26. She spent some time, she had a fellowship during law school,
27. and she spent time living with a Native American family.
28. And that gave her a lot of insights into the challenges of their lives because Native American people, the indigenous population, is not really known to most people, sadly.
29. She was introduced to the subject of our discussion today to Douglas Chief Stankowitz, a death row prisoner.
30. He told her the story of his case and she agreed to help him.
31. Through their efforts, the district attorney dropped death from his case in 2019.
32. In March 2025 they began filing the Racial Justice Act On May 29th the court granted the RJA Racial Justice Act motion
33. And that's what we're going to talk about. Maybe a little bit about how that functioned and how
34. that worked. And yeah, that's what it's about. Welcome to the show, Alexandra.

36. I don't know if everyone can you hear everyone Mark can you hear okay good all right Alexandra
37. um we do know that it that the racial justice act became really went into effect more in 2025
38. uh 2026 and opening the door for your motion and what came of it so can you talk a little bit about
39. Chief?
40. Chief Stankiewicz?
41. Chief Stankiewicz is a Monashie Indian,
42. and that tribe is from the eastern Sierra.
43. And he was convicted originally at age 19
44. of a special circumstances murder.
45. and he's been wrongfully incarcerated for 48 years now.
46. And so in the 12 years that I've been involved in the case,
47. we've done all sorts of things.
48. We don't have enough time to go into all the things we've done.
49. But, yeah.
50. And, you know, as many people know, our whole system,
51. The whole criminal, I call it the criminal legal system, because to me it's not a justice system, is totally stacked against defendants, especially people of color.
52. And, you know, when you look at the incarceration rates, you know, for people of color, there are many multiples of what they are for white people, you know, in this state and in our country, period, you know.
53. Yep.
54. So, and Jerry is right, the remedies that have been available are very, very limited, because one of the other factors is that our system is totally set up to protect the convictions that the prosecution gets, as opposed to protecting the rights of the people who have been convicted.
55. So it's really, you know, it's an uphill battle, even if someone is wrongfully convicted, in order to get the court to recognize that.
56. So we started researching, you know, how the Racial Justice Act could apply to Chief Stankiewicz's case.
57. And when we did, we found that there are a number of ways in which it could.
58. But should I backtrack for just a minute
59. And talk a little bit more about the RJA
60. So that people listening
61. In case they have anyone
62. You know, that might help
63. Have an idea
64. No, definitely do that
65. And also, just to understand
66. That this only came into play six years ago
67. And became maybe retroactive
68. Where people could apply, what, two years ago?
69. So yeah, please do
70. Because it's very, very important to anybody.
71. It is.
72. Just a very quick aside here just to show what a person can claim.
73. One of the men that I been working with for 16 years he was called an ape by the district attorney during the trial That cause for filing a claim but also clearly prejudicing the jury
74. However the word is, the jury.
75. Yeah, prejudicing.
76. Yeah.
77. But yes, please go ahead, Alexandra.
78. Talk about the JGA.
79. Yeah, just so that people can understand. So the RJA, yes, was only effective January 1 of 2021, and it's had a few amendments since then, most of them to strengthen the law.
80. and there are complexities to it.
81. And one of the biggest challenges is that even though we have this law
82. and the focus of the law is to eliminate racial bias in the criminal legal system,
83. the judges are reluctant to enforce it.
84. So, I mean, that's another problem that we've been having
85. all the way up to the California Supreme Court.
86. So, but it applies if there is racially biased language used during the trial, if there were actions like stops, police stops that were racially biased.
87. and then there are two other sections
88. one that says that if
89. and this is one of the ones that we're pursuing in
90. Chief's case that says that if
91. the prosecution charged
92. in this case Native Americans more
93. harshly than they did white people for the same
94. crimes then that
95. is actionable under the Racial Justice Act
96. with a variety of remedies. Ultimately
97. it's up to the judge to decide which remedy applies. And then the last one is disparate
98. treatment and sentencing. So if a Native American man received a greater sentence
99. than white men who were convicted of the same crime, then that would also be actionable,
100. perhaps with the remedy being a reduced sentence. So those are the basic components of the Racial
101. Justice Act. And then, of course, in order to prove a violation, there are a number of steps
102. that you have to go through in order to do that. And so the big win that we had in Chief Sankwitz's
103. case was that we won our discovery motion. So one of the steps in order to prove a claim
104. under the Racial Justice Act can be that you need to get data from the DA.
105. So we won this motion.
106. The court said that the DA has to provide us the data about conviction rates.
107. Let me stop you right there.
108. So in any case that's filed, I know a number of people are filing.
109. I don't know any victories yet in terms of people filing under the Racial Justice Act, but the DA has to turn over only that which shows racial bias?
110. Well the good news is that we have a statistician who understands all this part of it way I do not profess to understand this So anyway she understands all of this And so she provides us with a comprehensive list of what data she specifically needs
111. And then she has the ability to analyze that data for racial disparity.
112. Hmm.
113. And I do want to say that there was one win recently from the California Supreme Court in the case called Bankston.
114. And Bankston was under the death penalty, and the California Supreme Court found that there was racial bias during his trial.
115. and as a result, the death penalty has been removed
116. and we'll see now what goes from there.
117. Yeah, I definitely read about that
118. and read maybe that there were some issues related to it,
119. but it was good to see at any rate.
120. So talk more about the motion you filed, where it's at,
121. what's going on, what's happening.
122. And also, just a part of this may be cheap. You're saying he's been almost five decades in prison. What is his mental and his physical state after all this time?
123. well he's actually he's fared better than what you might expect um and who knows why you know
124. in part i would attribute it to the fact that he's native and he's just an incredibly strong
125. person i mean he was in solitary confinement for 20 years oh uh and yeah and then for another
126. 20 plus years he was on death row, which to me
127. is just another form of solitary confinement. We should call it that because
128. it operates the same way. So anyway,
129. he's managing okay and when
130. the governor changed the rules and sent
131. all of the death row inmates out to other prisons, they have
132. gotten some benefits from that. So he's able
133. to go outside now, you know, when he wants.
134. And he can participate in groups now, which he does.
135. So there are things that make his life better.
136. In the last two years, two years he's been at a different prison.
137. So what we have done, because the RJA area is,
138. newly developing. We filed a number of motions and what it came down to was that when we got
139. reassigned to a new judge, this judge wanted us to make a new discovery motion that combined
140. the content a lot of our other motions. So we did that and he reviewed everything and
141. we were surprised, actually, at how favorable his ruling was.
142. There is a story online if you want to look for it.
143. And originally it was published in the Fresno Bee,
144. but it was on Apple News for quite a while if you just Google Squaw Valley.
145. Alejandra, let me stop you for a minute.

150. Technology is, you know, reliable slash unreliable.

154. and the fact that people of color
155. are
156. so disproportionately
157. imprisoned
158. for same crimes
159. and that this is a huge
160. huge boon to them. It's really, really amazing
161. that we got something like this. You back with us,
162. Alexandra? Yes. Is this better?
163. So far, yeah. Okay.
164. So, yeah, no, as I say, I mean, it's amazing
165. legislation, and in fact, this last amendment,
166. because the courts have been reluctant to actually
167. follow this new law and or enforce it, the legislature put in a preamble section saying,
168. look, you know, we already know that racial bias exists, so we want you to do this now.
169. So, which is one of the things we cited in our 80-page motion. And so part of what was
170. very encouraging about getting our discovery motion granted is that in order to have good cause
171. to get our motion granted, we had to demonstrate racial bias against Native people in Fresno,
172. which seems like a ridiculous thing to have to prove, let me put it that way.
173. but anyway we did that
174. and as a result
175. the judge
176. in his ruling from the bench
177. acknowledged that there
178. has been genocide against
179. Native American people in California
180. that there is discrimination
181. against Native people in Fresno
182. which to me
183. was a big big deal
184. because rarely does that ever
185. get acknowledged
186. and thankfully there were
187. about a dozen indigenous relatives there
188. so they got to hear that.
189. And the reality is in Fresno
190. based on the content of our motion
191. there's discrimination against Native people
192. and other people of color I would add as a side note
193. in every aspect of law enforcement
194. and we have the documentation on that.
195. So now the district attorney has got time to gather the data, and we have a status hearing on August 14th for the court to, for the DA to be able to check in and tell the court what data they've gathered, what data they don't have, and so on and so forth.
196. So that's what the posture on it is right now.
197. So you don know what is going to be discovered in no I think I read somewhere that there was a Native American juror that was let go That true and that one that be coming next in our substantive motion
198. So this was more like a procedural motion that we just did.
199. But the judge acknowledged it.
200. We had it in our previous motion,
201. and yes, the only Native juror was removed from the jury by the DA
202. after he had properly questioned her,
203. and the judge acknowledged that,
204. and that could be enough to establish a racial Justice Act violation.
205. So when a violation is found, and probably more than one,
206. what next? What happens?
207. Well, what happens is then we ask the court,
208. Well, so there's a couple steps before a violation can be found, so I'll just put that out there.
209. But if the court agrees that there's a violation, then we make a proposal to the court to say,
210. okay, given this violation, here's what the remedy should be.
211. And so the removal of a juror who was of the same race is actionable,
212. as well as the question that was asked of the juror, and those all pertain to the guilt phase.
213. So, you know, that means that we would be asking for a new trial.
214. And as you can well imagine, it would not be easy for the prosecution to put on a new trial after 48 years.
215. Yeah, I can imagine. But the defense is so familiar with the case that it definitely puts you at an advantage. So it appears, given what you've told us, that that's almost a slam dunk.
216. well we lawyers never like to use that expression though especially in the criminal injustice system
217. you know yeah so because as i say there's many steps still you know that we have to go through
218. in order to get there but but we do have some i'll put it this way we have some very strong
219. evidence of racial bias on the record. So it's not as though it's a surmise, a guess. No, we have
220. the transcripts. Here's what was said and done. So yes, you're right. It's very strong.
221. Yeah. And even given that, if he was factually innocent through the years,
222. All my, the co-host today, Mark Cofield, told me there's a difference between factual and actual innocence.
223. So I don't know which one we're talking about.
224. But because of his innocence, you're probably, if it's a new trial, are you confined to just one issue?
225. Or is the whole thing tried again, the whole case?
226. No, the whole case would be tried again, is what they would have to do.
227. And of course, most of their witnesses are dead now.
228. And so they've told us before, well, they would try using transcripts.
229. But as you pointed out a minute ago, we're intimately familiar with this case now.
230. And even if they want to try the case on transcripts, we know where lies were told.
231. We know what was omitted.
232. And so we would be able to impeach all of that.
233. Whereas his previous lawyer never did any of that.
234. Yeah, that's the other thing.
235. That the other thing Yeah yeah Go ahead Yeah so there was for the legal eagles in the group there was a Batson error committed
236. which means that there was one or more jurors were wrongfully eliminated, jurors of the same race.
237. And that was actionable back in 1983.
238. but his lawyer did not do it.
239. He had a lawyer who was ineffective all the way around.
240. So, I mean, he never investigated.
241. He never interviewed any witnesses.
242. He didn't call any witnesses.
243. I mean, I have a list of all the things that he missed,
244. and it's probably at least 40 crucial things.
245. So, yeah, I mean, Chief Stankiewicz's case in a lot of ways is an American tragedy.
246. It really is because he's just gotten, you know, screwed over by the system every step of the way.
247. And I just want to put this out to listeners.

251. What is it, you know, the public, because now, you know, at least a large portion of the public that's involved and, you know, follows what happens in the criminal legal system, we are aware.
252. But what can we do?
253. What can the public do to help this along, if anything?
254. Well, one thing they can do is they could go to our website, www.justiceforchief.org,
255. and we have information on there about how to write letters to the governor.
256. I mean, we have a form letter asking for commutation because we put in an application back in 2020.
257. so you know and we can add to that application anytime um and of course on the website excuse me
258. you can learn about the case um we have you know all the things that we filed although saying this
259. now i realize we need to get our our new uh order in there from the judge but um so people can
260. educate themselves that way they can educate themselves about the racial justice act and stay
261. in touch with their legislators and let them know that they want more changes to this.
262. There was another, there was a bill in the legislature this year, but law enforcement
263. pushed back, and so it didn't go through.
264. Yeah.
265. And, you know, the more things that we, the more legislation that we have to strengthen
266. this, the better.
267. Exactly.

277. as you know are just profound And I may actually get my own inheritance but please keep the work up I mean I an emotional ball of a mess because I happy but I not used to being happy
278. Yeah, it's hard to come by in this country right now.

280. So you have native blood, Harold?
281. Yes, I do, from my grandfather.
282. He was from the Cahuilla Nation, but it was on what they called the Mexican side.
283. I don't know what that means.
284. And also, I have an uncle.
285. I mean, I'm sorry, my aunt was married to a Native American.
286. And he also, wow, he suffered immensely, too.
287. I mean, it was like a badge of courage for us was being arrested.
288. And the longer you stayed in jail, the braver you were deemed, you know?
289. Yeah.

300. You know, my point, this is so interesting because, you know, I've recently learned about natural law.

304. And what I hear, and one of the things I wanted to comment on was that, what's the chief's name?

307. So he has a Polish last name.
308. Yeah, he has a Polish last name because his dad was Polish Cherokee.

310. Well, that is so beautiful because, did you want to say something, Jerry?

316. My final comment is this. Now, justice,
317. you know, now we understand, we should start to understand
318. that it's just ice. You know, and you
319. might have heard recently that Trump blames the reflection pool
320. greenery on vandals? Well, he's partly correct because the problem is because of illegal algae
321. ends. Illegal algae ends. And what President Trump calls vandals, we all understand as
322. natural processes. And you know, my issue with our legal system today was something that your
323. guest has mentioned. And it's that it doesn't look out for the rights of the people. I work
324. I was a law clerk for,
325. he was a brilliant lawyer.
326. And he went into court and when he heard the opposing
327. counsel's brief in a domestic lawsuit case, he roused for a five-minute recess, went out into
328. the hall and said, you need to read these sections in the probate code and revise your brief.

330. The judge says we're going to, yes.

353. I just, I'm very excited that, and you should be too, Mark, considering the stops
354. by police that happen arbitrarily only because of race Convictions happen only because of race And that there finally might be an antidote to this is amazing
355. It shouldn't happen like this, but this is the reality in America.

359. You know, this country is, I think this country, the overwhelming majority, the overwhelmingly majority of people want to do the right thing.
360. And it's because of some people, I don't know why, but they don't have the ability to figure it out, to have common sense, to know when somebody's BSing you.
361. And this is why all of these laws that shouldn't even be being passed are passed.
362. Prime example, I was doing a little research on the independents, Republicans, and Democrats.
363. I have it right here.
364. 45% of the people in America are independents.
365. Really?
366. Yes.
367. Are you saying neither Democrat or Republican?
368. Neither Democrat or Republican.
369. They identify as independent, 27% Democrat, 27% Republican.
370. That's hard to believe.
371. Yes.
372. All you got to do is Google it.
373. And I was fascinated by that.
374. And it said most self-identified independents actually lean toward one or two major parties.
375. 20% lean Democrat, other 15% lean Republican.
376. Only about 10% are actually, are completely aligned and do not lean toward either.
377. So I would ask, why have the independents not banded, united, and put up some worthy candidates?
378. But you're making an assumption that the independents are not Nazis, you know, they could be more right than the...
379. Well, I just told you right here, it says that out of those 47%, 15, was it 15%?
380. It was 15%, no, 20% lean Democrat, and the other 15% lean Republican.
381. And the other 10 don't lean either or.
382. They're just aligned with being totally independent.
383. Yeah, so they may be a progressive bloc, because we know there is a progressive bloc in this.
384. You're an independent.
385. Yes, I'm registered independent.
386. And you're a progressive, whether you want to say it or not.
387. I'm a progressive when it comes down to issues of health care, when it comes down to issue of homelessness and things like that.
388. But I'm not a progressive when it comes to abortion.
389. I'm not, Jerry.

392. I'm not, but as I've said, but I don't feel I have the right to oppose my will on you.
393. See, the problem that I have, you have most of these men that's passing these laws is
394. all white men.
395. Oh yeah.
396. All white men trying to tell a woman in her 20s what she could do with her body.

405. Oh, man, what's on my mind is you guys are talking about entirely because there's a solution.
406. And with Alexandra, all of what you, Jerry, all of you are doing,
407. and then you having been incarcerated for 20 years for something you didn't do,
408. all of that is what is the issue, and, of course, judiciary.
409. So how do we begin a movement to stop it?
410. Well, here's what all people in prison can do immediately, and it's perfectly legal because we are the people.
411. If you take the 13th Amendment and simply redact, blackout, accept as a punishment for crime where the party shall have been duly convicted,
412. If you just redact that out of the 13th Amendment, it reads, neither slavery nor involuntary servitude shall exist within the United States or any place subject to their jurisdiction.
413. If two million people in prison would just get that 13th Amendment, start a movement to get that except as punishment crap, because that's just another way of saying slavery.
414. So it reads again, without that, neither slavery nor involuntary servitude shall exist within the United States or any place subject to their jurisdiction.
415. That's what the 13th Amendment would read if everybody in this nation would just redact that little exception out.
416. And that's what we can do to create a movement that will begin to get our judiciary on its right track.
417. Well, Jerry, correct me if I'm wrong.
418. I think you know where I'm getting ready to go with this.
419. I believe, didn't we just have that on the ballot in California?
420. I don't know that he got to the ballot.
421. He didn't.
422. Oh, he didn't get to the ballot?
423. But there is a strong movement, Stan, to remove slavery and involuntary servitude.
424. Exactly.
425. We need to push that.
426. We need to get it across the nation, and we can do it.
427. See, it's the start of something that can get rid of Trump.
428. Because as Mark knows, I've been calling about Stun, shift the unfit narrative for over a year.
429. And they are saying and they continue saying that they can get Trump out of there within six weeks legally, constitutionally, but nobody buys it.
430. So here's what Stun has done.
431. They have begun a process with a very wealthy person to create what Pacifica Foundation does, specifically KPFK and KPFA.
432. They create amounts of money that people match.
433. It's called a matching donation.
434. They are over million with this wealthy donator And that wealthy donator if that person will put up the million we have to match it and we will have it for Pacifica Foundation for Free Speech Radio
435. We need to start getting wealthy people to understand that they are the key to financially making this thing work.
436. And this is what our whole Constitution is hanging on, on the First Amendment.
437. I'm sorry to get emotional, but I've been working on this for four years.

525. I miss etiquette. I miss humanity, which he was just talking about. I miss the empathy. I miss those things. So Obama has just opened up this museum. And I noticed George Bush and his wife came. Bill Clinton and Hillary Clinton came.

550. And the agreement does it doesn't take away Iran's ballistic missiles.
551. it does not even take away the nuclear threat that they supposedly posed.
552. And he says that, okay, well, they promised they will have no nuclear weapons.
553. They had already made that promise.

555. So basically what I'm saying, he went in and did something that he shouldn't have been doing in the first place.
556. And now he got egg on his face and he agreed to give them $300 billion.

558. and Israel is not happy.
559. They're not happy at all.
560. But you know why he did what he did?

562. negotiated a good deal.
